F.S.; revising the circumstances used to determine 4
intestate succession involving certain persons born 5
out of wedlock; providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section 1. Paragraph (d) is added to subsection (2) of 10
section 732.108, Florida Statutes, to read: 11
732.108 Adopted persons and persons born out of wedlock. — 12
(2) For the purpose of intestate succession in cases not 13
covered by subsection (1), a person born out of wedlock is a 14
descendant of his or her mother and is one of the natural 15
kindred of all membe rs of the mother's family. The person is 16
also a descendant of his or her father and is one of the natural 17
kindred of all members of the father's family, if: 18
(d) The person is not a resident of this state or is not a 19
citizen of the United States and has b een named a legal heir by 20
a court in this state or the foreign country in which he or she 21
resides. 22
Section 2. This act shall take effect July 1, 2025. 23
