2424 Section 1. Section 607.0122, Florida Statutes, is amended 11

9999 Section 2. Subsection (12) of section 610. 104, Florida 62
100100 Statutes, is amended to read: 63
101101 610.104 State authorization to provide cable or video 64

103103 (12) Beginning 5 years after approval of the 66
104104 certificateholder's initial certificate of franchise issued by 67
105105 the department, and every 5 years the reafter, the 68
106106 certificateholder shall update the information contained in the 69
107107 original application for a certificate of franchise. At the time 70
108108 of filing the information update, the certificateholder shall 71
109109 pay a processing fee of $1,000. Any certificateholde r that fails 72
110110 to file the updated information and pay the processing fee on 73
111111 the 5-year anniversary dates shall be subject to cancellation of 74
112112 its state-issued certificate of franchise authority if, upon 75

125125 notice given to the certificateholder at its last addre ss on 76
126126 file with the department, the certificateholder fails to file 77
127127 the updated information and pay the processing fee within 30 78
128128 days after the date notice was mailed. The application and 79
129129 processing fees imposed in this section shall be paid to the 80
130130 Department of State for deposit into the Clearing Funds Trust 81
131131 Fund for immediate transfer by the Chief Financial Officer to 82
132132 the General Inspection Trust Fund of the Department of 83
133133 Agriculture and Consumer Services. The Department of Agriculture 84
134134 and Consumer Services shall maintain a separate account within 85
135135 the General Inspection Trust Fund to distinguish cable franchise 86
136136 revenues from all other funds. The application, any amendments 87
137137 to the certificate, or information updates must be accompanied 88
138138 by a fee to the Depar tment of State equal to that for filing 89
139139 articles of incorporation pursuant to s. 607.0122(1)(a) s. 90

141141 Section 3. This act shall take effect upon becoming a law 92
142142 if HB 1365 or similar legislation is adopted in the same 93
143143 legislative session or an extension thereof and becomes law . 94
