22	22	Be It Enacted by the Legislature of the State of Florida: 9

24	24	Section 1. Section 607.0122, Florida Statutes, is amended 11
25	25	to read: 12
26	26	607.0122 Fees for filing documents and issuing 13
27	27	certificates.— 14
28	28	(1) The department shall collect the following fees when 15
29	29	the documents described in this section are delivered to the 16
30	30	department for filing: 17
31	31	(a)(1) Articles of incorporation: $35. 18
32	32	(b)(2) Application for registered name: $87.50. 19
33	33	(c)(3) Application for renewal of registered name: $87.50. 20
34	34	(d)(4) Corporation's statement of change of registered 21

94	94	(2) A person may request expedited services by submitting 57
95	95	to the department an expedited service request form. A request 58
96	96	for expedited services must be made in person or through an 59
97	97	electronic transmission. A request for expedited services may 60
98	98	not be requested through mail. 61
99	99	Section 2. Subsection (12) of section 610. 104, Florida 62
100	100	Statutes, is amended to read: 63
101	101	610.104 State authorization to provide cable or video 64
102	102	service.— 65
103	103	(12) Beginning 5 years after approval of the 66
104	104	certificateholder's initial certificate of franchise issued by 67
105	105	the department, and every 5 years the reafter, the 68
106	106	certificateholder shall update the information contained in the 69
107	107	original application for a certificate of franchise. At the time 70
108	108	of filing the information update, the certificateholder shall 71
109	109	pay a processing fee of $1,000. Any certificateholde r that fails 72
110	110	to file the updated information and pay the processing fee on 73
111	111	the 5-year anniversary dates shall be subject to cancellation of 74
112	112	its state-issued certificate of franchise authority if, upon 75

125	125	notice given to the certificateholder at its last addre ss on 76
126	126	file with the department, the certificateholder fails to file 77
127	127	the updated information and pay the processing fee within 30 78
128	128	days after the date notice was mailed. The application and 79
129	129	processing fees imposed in this section shall be paid to the 80
130	130	Department of State for deposit into the Clearing Funds Trust 81
131	131	Fund for immediate transfer by the Chief Financial Officer to 82
132	132	the General Inspection Trust Fund of the Department of 83
133	133	Agriculture and Consumer Services. The Department of Agriculture 84
134	134	and Consumer Services shall maintain a separate account within 85
135	135	the General Inspection Trust Fund to distinguish cable franchise 86
136	136	revenues from all other funds. The application, any amendments 87
137	137	to the certificate, or information updates must be accompanied 88
138	138	by a fee to the Depar tment of State equal to that for filing 89
139	139	articles of incorporation pursuant to s. 607.0122(1)(a) s. 90

141	141	Section 3. This act shall take effect upon becoming a law 92
142	142	if HB 1365 or similar legislation is adopted in the same 93
143	143	legislative session or an extension thereof and becomes law . 94
