A bill to be entitled 1 
An act relating to public records; amending s. 98.075, 2 
F.S.; providing an exemption from public records 3 
requirements for records containing certain 4 
information received from another state after entering 5 
into a memorandum of understanding relating to voter 6 
registration records; providing for future legislative 7 
review and repeal of the exemption; providing a 8 
statement of public necessity; providing a contingent 9 
effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Paragraph (c) of subsection (2) of section 14 
98.075, Florida Statutes, is amended to read: 15 
 98.075  Registration records maintenance activities; 16 
ineligibility determi nations.— 17 
 (2)  DUPLICATE REGISTRATION. — 18 
 (c)  Information received by the department from another 19 
state or the District of Columbia upon the department entering 20 
into a memorandum of understanding with another state or 21 
becoming a member of a nongovernmenta l entity as provided in 22 
subparagraph (b)1., which is confidential or exempt pursuant to 23 
the laws of that state or the District of Columbia, is exempt 24 
from s. 119.07(1) and s. 24(a), Art. I of the State 25

Constitution. The department shall provide such inform ation to 26 
the supervisors to conduct registration list maintenance 27 
activities. 28 
 Section 2. The amendment to s. 98.075(2)(c), Florida 29 
Statutes, made by this act shall stand repealed on October 2, 30 
2030, unless reviewed and saved from repeal through reenact ment 31 
by the Legislature. 32 
 Section 3. The Legislature finds that it is a public 33 
necessity that information received by the Department of State 34 
from another state or the District of Columbia pursuant to a 35 
memorandum of understanding, which is confidential or exempt 36 
pursuant to the laws of that state or the District of Columbia, 37 
be made confidential and exempt from s. 119.07(1), Florida 38 
Statutes, and s. 24(a), Article I of the State Constitution. 39 
Entering into memoranda of understanding for the purpose of 40 
sharing and exchanging information to verify voter registration 41 
information is critical to ensuring the accuracy of the 42 
statewide voter registration system. Maintaining an accurate 43 
statewide voter registration system is critical to fair 44 
elections in this st ate. Without the public records exemption, 45 
the department will be unable to receive information directly 46 
from other states or the District of Columbia which might 47 
otherwise be confidential or exempt pursuant to the laws of 48 
those jurisdictions, which would impair the ability of the 49 
department and supervisors of elections to maintain accurate 50

voter rolls. As a result, the effective and efficient 51 
administration of the statewide voter registration system would 52 
be hindered. For these reasons, the Legislature fin ds that it is 53 
a public necessity to maintain the exempt status of such 54 
information received by the department. 55 
 Section 4. This act shall take effect on the same date 56 
that HB 1381 or similar legislation takes effect , if such 57 
legislation is adopted in the same legislative session or an 58 
extension thereof and becomes a law. 59
