A bill to be entitled 1 
An act relating to public records; amending s. 98.075, 2 
F.S.; providing an exemption from public records 3 
requirements for records containing certain 4 
information received from federal agencies, another 5 
state, or the District of Columbia after entering into 6 
a memorandum of understanding relating to voter 7 
registration records; providing for future legislative 8 
review and repeal of the exemption; providing a 9 
statement of public necessity; providing a contingent 10 
effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Paragraph (c) of subsection (2) of section 15 
98.075, Florida Statutes, is amended to read: 16 
 98.075  Registration record s maintenance activities; 17 
ineligibility determinations. — 18 
 (2)  DUPLICATE REGISTRATION. — 19 
 (c)  Information received by the department pursuant to 20 
from another state or the District of Columbia upon the 21 
department becoming a member of a nongovernmental entit y as 22 
provided in subparagraph (b)1., which is confidential or exempt 23 
pursuant to federal law or the laws of the applicable that state 24 
or the District of Columbia, is exempt from s. 119.07(1) and s. 25

24(a), Art. I of the State Constitution. The department sh all 26 
provide such information to the supervisors to conduct 27 
registration list maintenance activities. This paragraph shall 28 
stand repealed on October 2, 2030, unless reviewed and saved 29 
from repeal through reenactment by the Legislature. 30 
 Section 2. The Legislature finds that it is a public 31 
necessity that information received by the Department of State 32 
from a federal agency, another state, or the District of 33 
Columbia pursuant to a memorandum of understanding, which is 34 
confidential or exempt pursuant to fede ral law or the laws of 35 
the applicable state or the District of Columbia, be made 36 
confidential and exempt from s. 119.07(1), Florida Statutes, and 37 
s. 24(a), Article I of the State Constitution. Entering into 38 
memoranda of understanding for the purpose of sha ring and 39 
exchanging information to verify voter registration information 40 
is critical to ensuring the accuracy of the statewide voter 41 
registration system. Maintaining an accurate statewide voter 42 
registration system is critical to fair elections in this stat e. 43 
Without the public records exemption, the department will be 44 
unable to receive certain information directly from federal 45 
agencies, other states, or the District of Columbia which might 46 
otherwise be confidential or exempt pursuant to the laws of 47 
those jurisdictions, which would impair the ability of the 48 
department and supervisors of elections to maintain accurate 49 
voter rolls. As a result, the effective and efficient 50

administration of the statewide voter registration system would 51 
be hindered. For these rea sons, the Legislature finds that it is 52 
a public necessity to maintain the exempt status of such 53 
information received by the department. 54 
 Section 3. This act shall take effect on the same date 55 
that HB 1381 or similar legislation takes effect , if such 56 
legislation is adopted in the same legislative session or an 57 
extension thereof and becomes a law. 58
