23+Be It Enacted by the Legislature of the State of Florida: 10

25+ Section 1. Subsection (15) of section 408.810, Florida 12
26+Statutes, is amended to read: 13
27+ 408.810 Minimum licensure requirements. —In addition to the 14
28+licensure requirements specified in this part, authorizing 15
29+statutes, and applicable rules, each applicant and licensee must 16
30+comply with the requirements of this section in order to obtain 17
31+and maintain a license. 18
32+ (15)(a) The licensee must ensure that a person or entity 19
33+who possesses a direct controlling interest does not directly 20
34+hold, either directly or indirectly, regardless of ownership 21
35+structure, an interest in an entity that has a business 22
36+relationship with a foreign country of concern or that is 23
37+subject to s. 287.135. 24

52-Be It Enacted by the Legislature of the State of Florida: 27

54- Section 1. Section 287.138, Florida Statutes, is amended 29
55-to read: 30
56- 287.138 Contracting with entities of foreign countries of 31
57-concern prohibited.— 32
58- (1) As used in this sec tion, the term: 33
59- (a) "Controlling interest" means possession of the power 34
60-to direct or cause the direction of the management or policies 35
61-of a company, whether through ownership of securities, by 36
62-contract, or otherwise. A person or entity that directly or 37
63-indirectly has the right to vote 25 percent or more of the 38
64-voting interests of the company or is entitled to 25 percent or 39
65-more of its profits is presumed to possess a controlling 40
66-interest. 41
67- (b) "Department" means the Department of Management 42
68-Services. 43
69- (c) "Foreign country of concern" means the People's 44
70-Republic of China, the Russian Federation, the Islamic Republic 45
71-of Iran, the Democratic People's Republic of Korea, the Republic 46
72-of Cuba, the Venezuelan regime of Nicolás Maduro, the State of 47
73-Qatar, or the Syrian Arab Republic, including any agency of or 48
74-any other entity of significant control of such foreign country 49

88- (d) "Governmental entity" means any state, county, 51
89-district, authority, or municipal officer, department, division, 52
90-board, bureau, commission, or other separate unit of government 53
91-created or established by law including, but not limited to, the 54
92-Commission on Ethics, the Public Service Commission, the Office 55
93-of Public Counsel, and any other public or private agency, 56
94-person, partnership, corporation, or business entity acting on 57
95-behalf of any public agency. 58
96- (2)(a) A governmental entity may not knowingly enter into 59
97-a contract with an entity which would give access to an 60
98-individual's personal identifying information if: 61
99- 1.(a) The entity is owned by the government of a foreign 62
100-country of concern; 63
101- 2.(b) The government of a foreign country of concern has a 64
102-controlling interest in the entity; or 65
103- 3.(c) The entity is organized under the laws of or has its 66
104-principal place of business i n a foreign country of concern. 67
105- (b)(3) Beginning July 1, 2025, a governmental entity may 68
106-not extend or renew a contract with an entity listed in 69
107-paragraph (a) paragraphs (2)(a)-(c) if the contract would give 70
108-such entity access to an individual's personal identifying 71
109-information. 72
110- (3) Beginning October 15, 2025: 73
111- (a) A governmental entity may not enter into a contract 74

125-printers, or interoperable videoconferencing devices if: 76
126- 1. The government of a foreign country of concern has any 77
127-ownership interest, directly or indirectly, in the entity, or 78
128-any ownership interest, directly or indirectly, in any 79
129-subsidiary or parent company of the entity; 80
130- 2. The computers, printers, or interoperable 81
131-videoconferencing devices to be provided under the contract are 82
132-being furnished by a third party in which the government of a 83
133-foreign country of concern has any ownership interest, directly 84
134-or indirectly; or 85
135- 3. The entity has its principal place of business in a 86
136-foreign country of concern. 87
137- (b) A governmental entity may not extend or renew a 88
138-contract with an entity listed in paragraph (a). 89
139- (4)(a) Beginning October 15, 2025: January 1, 2024, 90
140- (a) A governmental entity may not accept a bid on, a 91
141-proposal for, or a reply to, or enter into, a contract with an 92
142-entity for goods or services described in paragraph (3)(a), or 93
143-which would grant the entity access to an individual's personal 94
144-identifying information , unless the entity provides the 95
145-governmental entity with a signed an affidavit, signed by an 96
146-officer or representative of the entity under penalty of 97
147-perjury, attesting that the entity does not meet any of the 98
148-criteria in paragraph (2)(a) or paragraph (3)(a) paragraphs 99

162- (b) Before an entity submits a b id, proposal, or reply to 101
163-provide goods or services to a governmental entity, the entity 102
164-must sign an affidavit, under penalty of perjury, attesting that 103
165-the entity does not meet any of the criteria in paragraph (2)(a) 104

167- (c)(b) Beginning July 1, 2025, When an entity extends or 106
168-renews a contract with a governmental entity for goods or 107
169-services described in paragraph (3)(a), or which would grant the 108

176- (5) The Attorney General may bring a civil action in any 115
177-court of competent jurisdiction against an entity that violates 116
178-this section. Violations of this section may result in: 117
179- (a) A civil penalty equal to twice the amount of the 118
180-contract for which the entity submitted a bid or proposal for, 119
181-replied to, or entered into; 120
182- (b) Ineligibility to enter into, renew, or extend any 121
183-other contract, including any grant agreements, with any 122
184-governmental entity for up to 5 years; 123
185- (c) Ineligibility to receive or r enew any license, 124
186-certification, or credential issued by a governmental entity for 125
