A BILL TO BE ENTITLED
AN ACT
To amend Chapter 23 of Title 47 of the Official Code of Georgia Annotated, relating to the

Georgia Judicial Retirement System, so as to repeal prohibitions against certain state court2
judges of Fulton County participating in other public retirement systems; to provide for3
related matters; to provide conditions for an effective date and automatic repeal; to repeal4
conflicting laws; and for other purposes.5
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6
SECTION 1.7
Chapter 23 of Title 47 of the Official Code of Georgia Annotated, relating to the Georgia8
Judicial Retirement System, is amended by revising paragraph (17) of Code Section 47-23-1,9
relating to definitions, as follows:10
"(17)  'State court' means any court created pursuant to the provisions of Chapter 7 of11
Title 15 or any court continued as a state court by Article VI, Section X of the12
Constitution of the State of Georgia; provided, however, that such term shall include the

State Court of Fulton County subject to the provisions of Code Section 47-23-50."14 23 LC 43 2582

SECTION 2.

Said chapter is further amended by revising Code Section 47-23-50, relating to retirement16
benefits for state judges serving Fulton County, as follows:17
"47-23-50.18
Any person who becomes a judge of the State Court of Fulton County on or after July 1,

2004, shall become a member of this retirement system by operation of law and shall not20
be a member of any other public retirement system Reserved."21
SECTION 3.22
This Act shall become effective on July 1, 2024, only if it is determined to have been23
concurrently funded as provided in Chapter 20 of Title 47 of the Official Code of Georgia24
Annotated, the "Public Retirement Systems Standards Law"; otherwise, this Act shall not25
become effective and shall be automatically repealed in its entirety on July 1, 2024, as26
required by subsection (a) of Code Section 47-20-50.27
SECTION 4.28
All laws and parts of laws in conflict with this Act are repealed.29
