B. 790 - 1 - House Bill 790 (AS PASSED HOUSE AND SENATE) By: Representatives Reeves of the 99 th , Kennard of the 101 st , Clark of the 100 th , Hong of the 103 rd , and Mughal of the 105 th A BILL TO BE ENTITLED AN ACT To amend an Act creating a new charter for the City of Suwanee, approved April 9, 1999 1 (Ga. L. 1999, p. 3729), as amended, particularly by an Act approved April 10, 2014 (Ga. L.2 2014, p. 3609), so as to change the corporate limits of said city; to repeal conflicting laws;3 and for other purposes.4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:5 SECTION 1.6 An Act creating a new charter for the City of Suwanee, approved April 9, 1999 (Ga. L. 1999,7 p. 3729), as amended, particularly by an Act approved April 10, 2014 (Ga. L. 2014, p. 3609),8 is amended by adding at the end of Section 1.11 a new subsection (e) to read as follows:9 "(e) Any other provisions of this section to the contrary notwithstanding, the following10 described property is included within the boundaries of the City of Suwanee:11 All that land contained within Land Lots 150, 151, 170, and 171 of the 7th District of12 Gwinnett County and more particularly described as follows: (POB) Starting in Land Lot13 151 of the 7th District in Gwinnett County at the southwest corner of the intersection of14 Old Peachtree Road and Horizon Drive and then proceeding in a north easterly direction15 along the western right of way line for Horizon Drive a distance of approximately 5,11716 23 LC 47 2429/AP H. B. 790 - 2 - feet to the northwest corner of the intersection of Old Peachtree Road and Horizon drive, 17 located in Land Lot 150 of the 7th District in Gwinnett County, and then turning west on18 Old Peachtree Road and proceeding along the northern right of way line for Old19 Peachtree Road for a distance of approximately 5,946 feet to the southwest corner of the20 intersection Old Peachtree Road and Horizon Drive in Land Lot 151 of the 7th District21 in Gwinnett County and the POB, which includes certain land that is already contained22 within the municipal boundary of the City of Suwanee, and includes parcels identified by23 the Gwinnett County Tax Assessors Office as R7151 046, R151 047, R7151 038, R715124 039, R7150 019, R7150 189, R7151 002, R7151 003, and R7151 004, as of March 9,25 2023;26 And:27 All that land contained within Land Lot 152 of the 7th District of Gwinnett County and28 more particularly described as follows: (POB) Starting in Land Lot 152 of the 7th District29 in Gwinnett County at the southwest corner of the intersection of Old Peachtree Road and30 Lawrenceville-Suwanee Road and then proceeding in a south westerly direction along the31 western right of way line for Old Peachtree Road for a distance of approximately 1,43032 feet to the northwest corner of the intersection of Old Peachtree Road and Celebration33 Connector and then continuing in a south westerly direction on Old Peachtree Road along34 the northern right of way line for Old Peachtree Road for a distance of approximately 89835 feet to the northwest corner of the intersection Old Peachtree Road and McGinnis Ferry36 Road and then turning and proceeding in a north westerly direction along McGinnis Ferry37 Road for a distance of approximately 499 feet to the northwest corner of the intersection38 of Old Peachtree Road and Celebration Drive and then turning and proceeding in a north39 easterly direction along the western right of way line for Celebration Drive for a distance40 of approximately 2,384 feet to the southwest corner of the intersection of41 Lawrenceville-Suwanee Road and Celebration Drive and then turning and proceeding in42 south easterly direction along the southern right of way line of Lawrenceville-Suwanee43 23 LC 47 2429/AP H. B. 790 - 3 - Road for a distance of 713 to the southwest corner of the intersection of Old Peachtree 44 Road and Lawrenceville-Suwanee Road and the POB, which includes certain land that45 is already contained within the municipal boundary of the City of Suwanee, and includes46 parcels identified by the Gwinnett County Tax Assessors Office as R7152 182, R152 171,47 R7152 170, R7152 177, R7152 173, and R7152 184, as of March 9, 2023;48 And:49 All that land contained within Land Lot 152 of the 7th District of Gwinnett County and50 more particularly described in the Final Plat for "JC Retail" dated September 9, 2007 and51 filed and recorded with the Superior Court Clerk for Gwinnett County, Georgia on July52 2, 2008 located in Plat Book 124, page 89 which includes certain land that is already53 contained within the municipal boundary of the City of Suwanee, and includes the parcel54 identified by the Gwinnett County Tax Assessors Office as R7152 040, as of March 9,55 2023;56 And: 57 All that land contained within Land Lot 152 of the 7th District of Gwinnett County and58 more particularly described in the As Built Survey and Lot Split for "Ingles Markets,59 Inc." filed and recorded with the Superior Court Clerk's Office for Gwinnett County,60 Georgia on March 6, 1990 located in Book 50, page 207, and includes the parcel61 identified by the Gwinnett County Tax Assessors Office as R7152 058, as of March 9,62 2023."63 SECTION 2.64 All laws and parts of laws in conflict with this Act are repealed.65
