A BILL TO BE ENTITLED
AN ACT
To amend Code Section 16-5-47 of the Official Code of Georgia Annotated, relating to

posting model notice with human trafficking hotline information in business and on internet,2
so as to require certain establishments to post human trafficking hotline information; to3
amend Chapter 24A of Title 43 of the Official Code of Georgia Annotated, relating to4
massage therapy practice, so as to provide for human trafficking awareness training for board5
members; to provide for inspections of massage therapy practices; to require licensees to6
display a photograph along with their massage therapy practice licenses; to provide for7
related matters; to repeal conflicting laws; and for other purposes.8
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:9
SECTION 1.10
Code Section 16-5-47 of the Official Code of Georgia Annotated, relating to posting model11
notice with human trafficking hotline information in business and on internet, is amended by12
adding two new paragraphs to subsection (a) and revising subsection (b) as follows:13
"(3.1)  'Body art studio' shall have the same meaning as set forth in paragraph (3) of Code

(3.2)  'Convenience store' means a retail establishment which offers for sale packaged or16
unprepared food and grocery items for consumption off the premises and may sell fuel17
products, household items, or tobacco products.  This shall not include establishments18
that offer for sale more than 20 different cuts of refrigerated meats or more than 50 types19
of whole produce."20
(6.1.) ‘Manufacturing facility’ means any facility that manufactures finished products;21
provided that more than 300 individuals are employed at such facility.”22
"(b)  Effective September 15, 2013, the following businesses and other establishments shall23
post the notice described in subsection (c) of this Code section, or a substantially similar24
notice, in English, Spanish, and any other language deemed appropriate by the director of25
the Georgia Bureau of Investigation, in each public restroom for the business or26
establishment and either in a conspicuous place near the public entrance of the business or27
establishment or in another conspicuous location in clear view of the public and employees28
where similar notices are customarily posted:29
(1)  Adult entertainment establishments;30
(2)  Bars;31
(3)  Primary airports;32
(4)  Passenger rail or light rail stations;33
(5)  Bus stations;34
(6)  Truck stops;35
(7)  Emergency rooms within general acute care hospitals;36
(8)  Urgent care centers;37
(9)  Farm labor contractors and day haulers;38
(10)  Privately operated job recruitment centers;39
(11)  Safety rest areas located along interstate highways in this state;40
(12)  Hotels;41

(13)  Businesses and establishments that offer massage or bodywork services by a42
massage therapist or a person who is not a massage therapist; and43
(14)  Government buildings; provided, however, that in the case of leased property, this44
paragraph shall only apply to public restrooms that are a part of such lease for exclusive45
use by the government entity;46
(15)  Convenience stores;47
(16)  Body art studios; and48
(17) Manufacturing facilities.”49
SECTION 2.50
Chapter 24A of Title 43 of the Official Code of Georgia Annotated, relating to massage51
therapy practice, is amended by adding a new subsection to Code Section 43-24A-5, relating52
to qualifications of board members and removal, to read as follows:53
"(d)  Each board member shall annually complete at least one-half hour of training in54
human trafficking awareness and prevention and shall provide documentation of such55
training to the chairperson of the board."56
SECTION 3.57
Said chapter is further amended by revising paragraph (4) of subsection (b) of Code Section58
43-24A-7, relating to powers of the board, as follows:59
"(4) Upon reasonable notice, request Initiate on-site inspections of the facility,60
equipment, policies, and practices of a massage therapy business or board recognized61
massage therapy educational program by appropriate inspectors in the Office office of the62
Secretary of State for the purpose of determining compliance with the standards63
established pursuant to this chapter;"64

Said chapter is further amended by revising subsection (a) of Code Section 43-24A-14,

relating to display of the license certificate, expiration and renewal of licenses, liability67
insurance coverage, change of address, and inactive status, as follows:68
"(a) The licensee shall display the license certificate or a photocopy thereof in an69
appropriate and public manner at each location at which he or she practices, with a
70
two-inch by two-inch photograph of the licensee taken within the last two years affixed71
thereto."72
SECTION 5.73
All laws and parts of laws in conflict with this Act are repealed.74
