	2	+	The House Committee on Regulated Industries offers the following substitute to SB 370:
6	3		A BILL TO BE ENTITLED
7	4		AN ACT
8		-	To amend Code Section 16-5-47 of the Official Code of Georgia Annotated, relating to

10	6		posting model notice with human trafficking hotline information in business and on internet,2
11	7		so as to require certain establishments to post human trafficking hotline information; to3
12	8		amend Chapter 24A of Title 43 of the Official Code of Georgia Annotated, relating to4
13	9		massage therapy practice, so as to provide for human trafficking awareness training for 5
14	10		members of the Georgia Board of Massage Therapy; to provide for inspections of massage6
15	11		therapy practices; to require licensees to display a photograph along with their massage7
16	12		therapy practice licenses; to provide for related matters; to repeal conflicting laws; and for8
17	13		other purposes.9
18	14		BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:10
19	15		SECTION 1.11
20	16		Code Section 16-5-47 of the Official Code of Georgia Annotated, relating to posting model12
21	17		notice with human trafficking hotline information in business and on internet, is amended by13
22	18		adding two new paragraphs to subsection (a) and revising subsection (b) as follows:14
23		-	"(3.1) 'Body art studio' shall have the same meaning as set forth in paragraph (3) of Code

28	23		(3.2) 'Convenience store' means a retail establishment which offers for sale packaged or17
29	24		unprepared food and grocery items for consumption off the premises and may sell fuel18
30	25		products, household items, or tobacco products. This shall not include establishments19
31	26		that offer for sale more than 20 different cuts of refrigerated meats or more than 50 types20
32	27		of whole produce."21
33	28		"(6.1.) 'Manufacturing facility' means any facility that manufactures finished products;22
34	29		provided that more than 300 individuals are employed at such facility."23
35	30		"(b) Effective September 15, 2013, the following businesses and other establishments shall24
36	31		post the notice described in subsection (c) of this Code section, or a substantially similar25
37	32		notice, in English, Spanish, and any other language deemed appropriate by the director of26
38	33		the Georgia Bureau of Investigation, in each public restroom for the business or27
39	34		establishment and either in a conspicuous place near the public entrance of the business or28
40	35		establishment or in another conspicuous location in clear view of the public and employees29
41	36		where similar notices are customarily posted:30
42	37		(1) Adult entertainment establishments;31
43	38		(2) Bars;32
44	39		(3) Primary airports;33
45	40		(4) Passenger rail or light rail stations;34
46	41		(5) Bus stations;35
47	42		(6) Truck stops;36
48	43		(7) Emergency rooms within general acute care hospitals;37
49	44		(8) Urgent care centers;38
50	45		(9) Farm labor contractors and day haulers;39
51	46		(10) Privately operated job recruitment centers;40
52	47		(11) Safety rest areas located along interstate highways in this state;41
53	48		(12) Hotels;42

56	51		(13) Businesses and establishments that offer massage or bodywork services by a43
57	52		massage therapist or a person who is not a massage therapist; and44
58	53		(14) Government buildings; provided, however, that in the case of leased property, this45
59	54		paragraph shall only apply to public restrooms that are a part of such lease for exclusive46
60	55		use by the government entity;47
61	56		(15) Convenience stores;48
62	57		(16) Body art studios;49
63	58		(17) Manufacturing facilities; and50
64	59		(18) Medical offices."51

66	61		Chapter 24A of Title 43 of the Official Code of Georgia Annotated, relating to massage53
67	62		therapy practice, is amended by adding a new subsection to Code Section 43-24A-5, relating54
68	63		to qualifications of board members and removal, to read as follows:55
69	64		"(d) Each board member shall annually complete at least one-half hour of training in56
70	65		human trafficking awareness and prevention and shall provide documentation of such57
71	66		training to the chairperson of the board."58

73	68		Said chapter is further amended by revising paragraph (4) of subsection (b) of Code Section60
74	69		43-24A-7, relating to powers of the board, as follows:61
75	70		"(4) Upon reasonable notice, request Initiate on-site inspections of the facility,62
76	71		equipment, policies, and practices of a massage therapy business or board recognized63
77	72		massage therapy educational program by appropriate inspectors in the Office office of the64
78	73		Secretary of State for the purpose of determining compliance with the standards65
79	74		established pursuant to this chapter;"66

84	78		Said chapter is further amended by revising subsection (a) of Code Section 43-24A-14,68
85	79		relating to display of the license certificate, expiration and renewal of licenses, liability69
86	80		insurance coverage, change of address, and inactive status, as follows:70
87	81		"(a) The licensee shall display the license certificate or a photocopy thereof in an71
88		-	appropriate and public manner at each location at which he or she practices, with a
