25 LC 48 1443 Senate Resolution 167 By: Senators Kemp of the 38th, Jackson of the 41st, Jones II of the 22nd, Parent of the 44th, Wicks of the 34th and others A RESOLUTION Proposing an amendment to the Constitution so as to repeal the recognition of marriage as 1 only the union of man and woman; to provide for related matters; to provide for the2 submission of this amendment for ratification or rejection; and for other purposes.3 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:4 SECTION 1.5 Article I of the Constitution is amended by repealing Section IV in its entirety and enacting6 a new Section IV to read as follows:7 "SECTION IV. 8 MARRIAGE9 Paragraph I. Recognition of marriage. (a) This state shall recognize as marriage any10 union between two persons legally authorized to marry, regardless of race, gender, or11 biological sex, who are of sound mind, who have no living spouse from a previously12 undissolved marriage, and who are not related to their prospective spouse by blood or13 marriage within the prohibited degrees.14 S. R. 167 - 1 - 25 LC 48 1443 (b) This state shall give effect to any public act, record, or judicial proceeding of any15 other state or jurisdiction respecting a relationship between interracial persons or persons16 of the same gender or biological sex that is treated as a marriage under the laws of such17 other state or jurisdiction. The courts of this state shall have jurisdiction to grant a divorce18 or separate maintenance and to consider or rule on any of the parties' respective rights19 arising from interracial or same-sex marriage unions."20 SECTION 2.21 The above proposed amendment to the Constitution shall be published and submitted as22 provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the23 above proposed amendment shall have written or printed thereon the following:24 "( ) YES25 ( ) NO26 27 Shall the Constitution of Georgia be amended so as to recognize marriage as any union between two persons authorized to marry under Georgia law regardless of race, gender, or biological sex?" All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." 28 All persons desiring to vote against ratifying the proposed amendment shall vote "No." If29 such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall30 become a part of the Constitution of this state.31 S.
