47- SECTION 1. The legislature finds that smoke alarms, when properly installed and maintained, play a vital role in reducing fire deaths and injuries. When there is a fire, smoke spreads fast and working smoke alarms give people an early warning so they can escape quickly. Smoke alarms are a key part of a home fire escape plan. The purpose of this Act is to require sellers of buildings or structures that are wholly or partially occupied for residential purposes to be equipped with approved smoke alarms. SECTION 2. Chapter 132, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows: "§132- Smoke alarms; residences. (a) All buildings or structures that are wholly or partially occupied for residential purposes shall be equipped by the seller, upon the sale or transfer of the building or structure, with approved smoke alarms in accordance with current state or county building or residential codes. (b) The applicable county fire department shall enforce this section." SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect on July 1, 2050.
