47- SECTION 1. The purpose of this Act is to provide an extensive process for limited firearm ownership for hunting or sport only for certain misdemeanor offenders who are currently not allowed to possess a firearm in the State. SECTION 2. Section 134-7, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows: "(b) No person who is under indictment for, or has waived indictment for, or has been bound over to the circuit court for, or has been convicted in this State or elsewhere of having committed a felony, or any crime of violence, or an illegal sale of any drug shall own, possess, or control any firearm or ammunition therefor[.]; provided that unless otherwise prohibited by this section, a person who has been convicted of a misdemeanor: (1) Crime of violence, except for a misdemeanor crime of domestic violence; or (2) Illegal sale of any drug, ten years after the date the person was sentenced for the offense, may petition the circuit court in the county in which the person resides for a hearing to determine competency to own, possess, or control a hunting firearm for the purposes of target shooting or game hunting; provided that the person has not been subsequently convicted of any offense. The petitioner shall have the right to secure an independent medical or psychological evaluation and present evidence in a hearing under this subsection. Upon a finding of competency, the court shall order the petitioner to complete an approved hunter education course as authorized under section 183D-28 before authorizing the petitioner to own, possess, or control a hunting firearm. As used in this subsection, "hunting firearm" means a long gun or a muzzle loader firearm." SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored. SECTION 4. This Act shall take effect on July 1, 2050.
