| 45 | | - | WHEREAS, technology has become increasingly prevalent as a means of communication and is more accessible than ever before; and WHEREAS, service of notice and process in non-criminal proceedings cannot currently be transmitted through electronic mail; and WHEREAS, electronic mail could be an easier and more efficient means of serving initial notice and process of a lawsuit or proceeding; and WHEREAS, however, there could also be unforeseen complications with electronic mail, such as an inability to access technology, unsuccessful delivery, or evasion of confirmation of service; and WHEREAS, a task force could identify unforeseen complications and develop a system to best transmit service of notice and process via electronic mail; now, therefore, BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, the Senate concurring, that a task force is requested to be created and established within the Judiciary to determine the feasibility of and best system to transmit initial service of notice and process via electronic email; and BE IT FURTHER RESOLVED that the task force be comprised of: (1) One member designated by the Judiciary; (2) One member designated by the President of the Senate; (3) One member designated by the Speaker of the House of Representatives; (4) One member designated by the Department of the Attorney General; (5) One member designated by the Office of the State Public Defender; and (6) One member designated by the Department of the Prosecuting Attorney for the City and County of Honolulu; and BE IT FURTHER RESOLVED that the task force select a chair from among its members and allow the chair of the task force to invite other interested parties to join the task force; and BE IT FURTHER RESOLVED that members of the task force shall serve without compensation, but shall be reimbursed for reasonable expenses necessary for the performance of their duties, including travel expenses; and BE IT FURTHER RESOLVED that the task force shall be exempt from chapter 92, Hawaii Revised Statutes; and BE IT FURTHER RESOLVED that the task force is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2023; and BE IT FURTHER RESOLVED that the task force should cease to exist on June 30, 2023; and BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chief Justice of the Hawaii Supreme Court, Attorney General, State Public Defender, and Prosecuting Attorney of the City and County of Honolulu.
