4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 SECTION 1. Chapter 52D, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows: "§52D- Acquisition of military type equipment; prohibited. (a) No police department shall acquire, purchase, or otherwise accept: (1) Weaponized unmanned aerial vehicles; (2) Aircraft that are configured for combat or are combat-coded and have no established commercial flight application; (3) Grenade launchers and grenades or similar explosives and explosive delivery devices; (4) Military standard issue rifles; (5) Armored multi-wheeled vehicles that are mine-resistant, ambush-protected, and configured for combat from a surplus program operated by the federal government; (6) Camouflage uniforms; or (7) Sound cannons, sound energy weapons, or long range acoustic devices; provided that this section shall not prohibit a police department from taking possession of any item in paragraphs (1) through (7) in the course of an investigation as evidence. (b) A police department may petition the director of public safety for approval to acquire items listed in subsection (a) for use by special weapons and tactics teams and other specialized service units. §52D- Use of certain devices in situations involving protests or demonstrations; prohibited. (a) No law enforcement officer employed by a police department shall use kinetic energy munitions or a noxious chemical agent in any action involving protests or demonstrations. (b) For the purposes of this section: "Kinetic energy munitions" includes impact projectiles; rubber or foam baton projectiles; bean bag projectiles; and projectiles coated in plastic, wax, wood, or rubber. "Noxious chemical agent" includes tear gas, mustard gas, phosgene gas, and any other chemical or mixture of chemicals formulated to produce nausea or other injurious effects upon contact or inhalation."
