4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

4747 Section 1. The legislature finds that Hawaii residential real property sales and median home sales prices have significantly increased during the coronavirus disease 2019 (COVID-19) pandemic, further exacerbating the shortage in housing inventory for local residents. The pandemic has also significantly reduced revenues for the State to continue vital operations that help drive the local economy such as those provided by the bureau of conveyances within the department of land and natural resources. The purpose of this Act is to: (1) Assist local residents in participating in the Hawaii housing market by modifying the fees charged by the bureau of conveyances; and (2) Provide increased revenues for the bureau of conveyances to maintain its operations. SECTION 2. The Hawaii department of land and natural resources, bureau of conveyances shall amend its administrative rules, as appropriate and in accordance with chapter 91, Hawaii Revised Statutes, to impose fees in the following amounts: (1) General fees charged to Hawaii residents shall include: (A) For uncertified copies of documents, $1 per page; and (B) For certified copies of documents, $10 plus $1 per page; and (2) Land court fees charged to Hawaii residents shall include: (A) For recording a document up to and including fifty pages, $36 per document; (B) For recording a document with fifty-one pages or more, $101 per document; (C) For each issuance of a certificate of title, $50; (D) For each additional memorandum on certificates required by any one instrument, $5; and (E) For each certified copy of a title, $10; and (3) Regular system fees charged to Hawaii residents shall include: (A) For a regular system recording fee of up to and including fifty pages, $41 per document; and (B) For a regular system recording fee of fifty-one pages or more, $106 per document; and (4) General Fees for non-residents shall include: (A) For uncertified copies of documents, $10 per page; and (B) For certified copies, $100 plus $10 per page; and (5) Land court fees for non-residents shall include: (A) For recording a document of up to and including fifty pages, $360 per document; (B) For recording a document with fifty-one pages or more, $1,010 per document; (C) For each certificate of title issuance, $500; (D) For each additional memorandum on certificates required by any one instrument, $50; and (E) For each certified copy of a certificate of title, $100; and (6) Regular system fees for non-residents shall include: (A) For a regular system recording fee of up to and including fifty pages, $410 per document; and (B) For a regular system recording fee of fifty-one pages or more, $1,060 per document. SECTION 3. This Act shall take effect upon its approval.
