3737 RELATING TO THE KAAAWA-HAUULA COMMUNITY-BASED LONG-RANGE TRANSPORTATION PLAN.

47- SECTION 1. The legislature acknowledges the escalating challenges posed by climate change and coastal erosion and the imperative need to preserve access to rural communities along our coastlines. Recognizing the specific vulnerabilities faced by the communities of Kaaawa, Punaluu, and Hauula, including the urgency of addressing coastal erosion and road conditions, the legislature finds that it is essential to embark on community‑based, long-range planning tailored to the unique needs of these communities. The legislature is committed to strategically addressing the threats of climate change and coastal erosion by discussing the future of Kamehameha highway in Kaaawa, Punaluu, and Hauula with the community and finding solutions to maintain transportation routes that link these rural communities. Preserving the integrity of vital transportation infrastructure is important so communities can have uninterrupted access to goods, services, and emergency assistance. The legislature further finds that it is important to foster collaboration and involve key stakeholders in the decision-making process. It is important for state departments, local organizations, and community members to be a part of the conversation in shaping the future of Kamehameha highway. Accordingly, the purpose of this Act is to appropriate funds for and require the involvement of community members and organizations in the development of a community-based, long-range transportation plan for the Kaaawa, Punaluu, and Hauula communities. SECTION 2. (a) The department of transportation shall develop a community-based, long-range transportation plan to devise and implement long-term solutions for coastal erosion along Kamehameha highway from Kaaawa to Hauula. (b) To ensure the involvement of key community stakeholders in this planning process, the department of transportation and any entity designated by the department of transportation shall invite and consult with the following entities or individuals in the development process of the Kaaawa-Hauula community-based, long-range transportation plan: (1) The department of land and natural resources; (2) Koolauloa Neighborhood Board; (3) Koolauloa Hawaiian Civic Club; (4) Kaaawa Community Association; (5) Punaluu Community Association; and (6) Hauula Community Association. (c) The department of transportation shall complete its Kaaawa-Hauula community-based, long-range transportation plan and submit the plan to the legislature no later than December 31, 2026. SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2024-2025 to develop the Kaaawa-Hauula community-based, long-range transportation plan. The sum appropriated shall be expended by the department of transportation for the purposes of this Act. SECTION 4. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37‑91 and 37‑93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in H.B. No. , will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. In addition, the appropriation contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024‑2025 to be further exceeded by $ or per cent. The combined total amount of general fund appropriations contained in only these two Acts will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. The reasons for exceeding the general fund expenditure ceiling are that: (1) The appropriation made in this Act is necessary to serve the public interest; and (2) The appropriation made in this Act meets the needs addressed by this Act. SECTION 5. This Act shall take effect on July 1, 3000.
