The legislature finds that many children with autism spectrum disorder or fetal alcohol spectrum disorder have high needs for intensive behavioral therapies when forced to adapt to new situations and activities during their transition into adulthood. However, at age twenty-one, people with autism spectrum disorder or fetal alcohol spectrum disorder no longer qualify for medicaid coverage under the early and periodic screening, diagnostic, and treatment medicaid benefit, and there is no mandate that these services be provided. The purpose of this Act is to research and make recommendations on the most appropriate services for individuals twenty-six years of age or younger with autism spectrum disorder or fetal alcohol spectrum disorder and how services may be covered under amendments to the medicaid state plan or medicaid 1925(c) waiver. SECTION 2. The department of health, department of human services, and department of education shall: (1) Research any rules, policies, and amendments to the medicaid state plan or medicaid 1915(c) waiver that are necessary to ensure provision of clinically appropriate treatments and services for individuals twenty-six years of age or younger with autism spectrum disorder or fetal alcohol spectrum disorder are covered under the following programs: (A) The early and periodic screening, diagnostic, and treatment benefit under the State's medicaid program; (B) Any applicable state special education services and programs; and (C) The medicaid section 1915(c) home and community based services waiver for individuals with intellectual and developmental disabilities; and (2) Make recommendations on any policy actions or funding that may be needed to implement the recommended rule, policy, or amendment to the medicaid state plan or medicaid 1915(c) waiver. SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2024-2025 for the department of health, department of human services, and department of education to carry out the research and recommendations as required under section 2 of this Act. The sum appropriated shall be expended by the department of human services for the purposes of this Act. SECTION 4. In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37‑91 and 37‑93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in H.B. No. , will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. In addition, the appropriation contained in this Act will cause the general fund expenditure ceiling for fiscal year 2024‑2025 to be further exceeded by $ or per cent. The combined total amount of general fund appropriations contained in only these two Acts will cause the state general fund expenditure ceiling for fiscal year 2024‑2025 to be exceeded by $ or per cent. The reasons for exceeding the general fund expenditure ceiling are that: (1) The appropriation made in this Act is necessary to serve the public interest; and (2) The appropriation made in this Act meets the needs addressed by this Act. SECTION 5. This Act shall take effect on July 1, 3000. |

The department of health, department of human services, and department of education shall research any rules, policies, and state plan amendments that are necessary to ensure that clinically appropriate treatments and services for individuals twenty-six years of age of younger with autism spectrum disorder or fetal alcohol spectrum disorder are covered under the following: (1) The early and periodic screening, diagnostic, and treatment benefit under the State's medicaid program; (2) Any applicable state special education services and programs; and (3) The medicaid section 1915(c) home and community based services waiver for individuals with intellectual and developmental disabilities.
