4343 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

47- SECTION 1. Chapter 291, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows: "Part . public parking spaces §291-A Definitions. As used in this part: "Motor vehicle" means every vehicle that is self-propelled or propelled by electric power but not operated upon rails. "Parking meter" means a device located in the vicinity of a parking space and that grants parking privileges to persons for a certain time period upon payment of required parking fees by a method allowed by the device. "Parking meter" includes multi‑space parking meter devices located in the vicinity of parking spaces regulated by the device. "Public paid parking space" means any space that is designated for use by the general public as a space to park one or more motor vehicles upon payment of required parking fees. §291-B Parking fees; payment method. Effective January 1, 2026, each parking lot in the State having public paid parking spaces shall accept payment of parking fees by credit card and debit card. Each parking meter in the State that collects parking fees for any public paid parking space shall be maintained in working order to accept payment by credit card and debit card. Nothing in this section shall be construed to prohibit a parking lot having public paid parking spaces or parking meters from accepting payment by cash. §291-C Ordinances to enforce authorized. Each county shall adopt ordinances to enforce the requirements of section 291-B, including the establishment of penalties for failure to comply with the requirements of that section." SECTION 2. Each state agency that operates a parking lot with public paid parking spaces and each county shall submit an annual report of their progress implementing this Act, to the legislature no later than twenty days prior to the convening of each regular session. SECTION 3. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act. SECTION 4. This Act shall take effect upon its approval.
