S.F. 2429 Section 1. Section 257.1, subsection 2, paragraph b, Code 1 2024, is amended to read as follows: 2 b. For the budget year commencing July 1, 1999, and for 3 each succeeding budget year beginning before July 1, 2022, 4 the regular program foundation base per pupil is eighty-seven 5 and five-tenths percent of the regular program state cost per 6 pupil. For the budget year commencing July 1, 2022, and for 7 each succeeding budget year, the regular program foundation 8 base per pupil is eighty-eight and four-tenths percent of the 9 regular program state cost per pupil. For the budget year 10 commencing July 1, 1991, and for each succeeding budget year 11 the special education support services foundation base is 12 seventy-nine percent of the special education support services 13 state cost per pupil. The combined foundation base is the sum 14 of the regular program foundation base, the special education 15 support services foundation base, the total teacher salary 16 supplement district cost, the total professional development 17 supplement district cost, the total early intervention 18 supplement district cost, the total teacher leadership 19 supplement district cost, the total area education agency 20 teacher salary supplement district cost, and the total area 21 education agency professional development supplement district 22 cost , and the total area education agency support supplement 23 district cost . 24 Sec. 2. Section 257.4, subsection 1, paragraph a, Code 2024, 25 is amended by adding the following new subparagraph: 26 NEW SUBPARAGRAPH . (11) The total area education agency 27 support supplement district cost. 28 Sec. 3. Section 257.8, subsection 2, Code 2024, is amended 29 to read as follows: 30 2. Categorical state percent of growth. The categorical 31 state percent of growth for the budget year beginning July 32 1, 2021, is two and four-tenths percent. The categorical 33 state percent of growth for the budget year beginning July 34 1, 2022, is two and one-half percent. The categorical state 35 -1- LSB 5897XS (2) 90 dg/jh 1/ 6
S.F. 2429 percent of growth for the budget year beginning July 1, 2023, 1 is three percent. The categorical state percent of growth 2 for each budget year shall be established by statute which 3 shall be enacted within thirty days of the transmission of the 4 governors budget required by February 1 under section 8.21 5 during the regular legislative session beginning in the base 6 year. The categorical state percent of growth may include 7 state percents of growth for the teacher salary supplement, the 8 professional development supplement, the early intervention 9 supplement, the teacher leadership supplement, and for budget 10 years beginning on or after July 1, 2020, transportation equity 11 aid payments under section 257.16C , and for budget years 12 beginning on or after July 1, 2025, the area education agency 13 support supplement . 14 Sec. 4. Section 257.9, Code 2024, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 12. Area education agency support supplement 17 state cost per pupil. 18 a. For the budget year beginning July 1, 2024, the area 19 education agency support supplement state cost per pupil shall 20 be one hundred million dollars divided by the statewide special 21 education support services weighted enrollment for the fiscal 22 year. 23 b. For the budget year beginning July 1, 2025, and 24 succeeding budget years, the area education agency support 25 supplement state cost per pupil shall be the amount calculated 26 by the department of management under this subsection for 27 the base year plus a supplemental state aid amount that is 28 equal to the support supplement categorical state percent of 29 growth, pursuant to section 257.8, subsection 2, for the budget 30 year, multiplied by the amount calculated by the department of 31 management under this subsection for the base year. 32 Sec. 5. Section 257.10, subsection 8, paragraph a, Code 33 2024, is amended to read as follows: 34 a. Combined district cost is the sum of the regular program 35 -2- LSB 5897XS (2) 90 dg/jh 2/ 6
S.F. 2429 district cost per pupil multiplied by the weighted enrollment, 1 the special education support services district cost, the 2 total teacher salary supplement district cost, the total 3 professional development supplement district cost, the total 4 early intervention supplement district cost, and the total 5 teacher leadership supplement district cost, plus the sum of 6 the additional district cost allocated to the district to fund 7 media services and educational services provided through the 8 area education agency, the area education agency total teacher 9 salary supplement district cost , the area education agency 10 support supplement district cost, and the area education agency 11 total professional development supplement district cost. 12 Sec. 6. Section 257.10, Code 2024, is amended by adding the 13 following new subsection: 14 NEW SUBSECTION . 12A. Area education agency support 15 supplement district cost. 16 a. For the budget year beginning July 1, 2024, the 17 department of management shall allocate and divide one hundred 18 million dollars by the districts budget enrollment in the 19 fiscal year beginning July 1, 2024, to determine the area 20 education agency support supplement cost per pupil. For the 21 budget year beginning July 1, 2025, and succeeding budget 22 years, the area education agency support supplement district 23 cost per pupil for each school district for a budget year is 24 the area education agency support supplement district cost per 25 pupil for the base year plus the area education agency support 26 supplement supplemental state aid amount for the budget year. 27 b. For the budget year beginning July 1, 2025, and 28 succeeding budget years, if the department of management 29 determines that the unadjusted area education agency support 30 supplement district cost of a school district for a budget 31 year is less than one hundred percent of the unadjusted area 32 education agency support supplement district cost for the 33 base year for the school district, the school district shall 34 receive a budget adjustment for that budget year equal to the 35 -3- LSB 5897XS (2) 90 dg/jh 3/ 6

(1) The unadjusted area education agency support 2 supplement district cost is the area education agency support 3 supplement district cost per pupil for each school district for 4 a budget year multiplied by the sum of the budget enrollment 5 for that school district plus the number of resident pupils in 6 the school district that received an education savings account 7 payment under section 257.11B for the base year. 8 (2) The total area education agency support supplement 9 district cost is the sum of the unadjusted area education 10 agency support supplement district cost plus the budget 11 adjustment for that budget year. 12 Sec. 7. Section 257.16, subsection 4, Code 2024, is amended 13 to read as follows: 14 4. Notwithstanding any provision to the contrary, if 15 the governor orders budget reductions in accordance with 16 section 8.31 , the teacher salary supplement district cost, 17 the professional development supplement district cost, the 18 early intervention supplement district cost, and the teacher 19 leadership supplement district cost , and the area education 20 agency support supplement district cost as calculated under 21 section 257.10, subsections 9, 10, 11, and 12 , and 12A, and 22 the area education agency teacher salary supplement district 23 cost and the area education agency professional development 24 supplement district cost as calculated under section 257.37A, 25 subsections 1 and 2 , shall be paid in full as calculated and 26 the reductions in the appropriations provided in accordance 27 with this section shall be reduced from the remaining moneys 28 appropriated pursuant to this section and shall be distributed 29 on a per pupil basis calculated with the weighted enrollment 30 determined in accordance with section 257.6, subsection 5 . 31 Sec. 8. Section 257.35, subsection 1, Code 2024, is amended 32 to read as follows: 33 1. The department of management shall deduct the amounts 34 calculated for special education support services, media 35 -4- LSB 5897XS (2) 90 dg/jh 4/ 6
S.F. 2429 services, area education agency teacher salary supplement 1 district cost, area education agency professional development 2 supplement district cost, area education agency support 3 supplement district cost, and educational services for each 4 school district from the state aid due to the district pursuant 5 to this chapter and shall pay the amounts to the respective 6 area education agencies on a monthly basis from September 15 7 through June 15 during each school year. The department of 8 management shall notify each school district of the amount 9 of state aid deducted for these purposes and the balance of 10 state aid shall be paid to the district. If a district does 11 not qualify for state aid under this chapter in an amount 12 sufficient to cover its amount due to the area education agency 13 as calculated by the department of management, the school 14 district shall pay the deficiency to the area education agency 15 from other moneys received by the district, on a quarterly 16 basis during each school year. 17 Sec. 9. Section 257.37A, Code 2024, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 3. Area education agency support supplement 20 cost per pupil and district cost. 21 a. (1) For the budget year beginning July 1, 2024, the area 22 education agency support supplement district cost per pupil 23 shall be one hundred million dollars divided by the special 24 education support services weighted enrollment for the fiscal 25 year. 26 (2) For the budget year beginning July 1, 2025, and 27 succeeding budget years, the area education agency support 28 supplement district cost per pupil for each area education 29 agency for a budget year is the area education agency support 30 supplement supplemental state aid amount for the budget year. 31 b. For the budget year beginning July 1, 2025, and 32 succeeding budget years, if the department of management 33 determines that the unadjusted area education agency support 34 supplement district cost of an area education agency for a 35 -5- LSB 5897XS (2) 90 dg/jh 5/ 6
S.F. 2429 budget year is less than one hundred percent of the unadjusted 1 area education agency support supplement district cost for the 2 base year for the area education agency, the area education 3 agency shall receive a budget adjustment for that budget year 4 equal to the difference. 5 c. (1) The unadjusted area education agency support 6 supplement district cost is the area education agency support 7 supplement district cost per pupil for each area education 8 agency for a budget year multiplied by the special education 9 support services weighted enrollment for that area education 10 agency. 11 (2) The total area education agency support supplement 12 district cost is the sum of the unadjusted area education 13 agency support supplement district cost plus the budget 14 adjustment for that budget year. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanations substance by the members of the general assembly. 18 This bill establishes an area education agency support 19 supplement categorical. 20 Each budget year, area education agencies receive funding 21 through various categoricals. The bill allocates $100 million 22 for the purposes of an area education agency support supplement 23 categorical. The area education agency support supplement 24 categorical district cost per pupil and state cost per pupil 25 for the budget year beginning July 1, 2024, is $100 million 26 divided by the statewide special education support services 27 weighted enrollment for the fiscal year. For budget years 28 beginning on or after July 1, 2025, the area education agency 29 support supplement categorical is calculated by multiplying the 30 amount allocated for the categorical in the previous budget 31 year by the categorical state percent of growth. 32 -6- LSB 5897XS (2) 90 dg/jh 6/ 6
