1212 1 AN ACT concerning State government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois State Police Law of the Civil
1616 5 Administrative Code of Illinois is amended by adding Section
1717 6 2605-490 as follows:

1919 8 Sec. 2605-490. Illinois active shooter alert system.
2020 9 (a) The Illinois State Police, with the cooperation of the
2121 10 Governor, the Illinois Department of Transportation, any other
2222 11 appropriate State agency, and State or local police and public
2323 12 safety agencies, shall develop and implement an alert system
2424 13 to be activated upon the report of an active shooter.
2525 14 (b) The Director of the Illinois State Police shall be the
2626 15 statewide coordinator of the alert system. The coordinator
2727 16 shall adopt rules and issue directives as necessary to ensure
2828 17 proper implementation of the alert system. The rules and
2929 18 directives shall prescribe procedures for local law
3030 19 enforcement agencies to request activation of the alert
3131 20 system.
3232 21 (c) The Illinois State Police shall recruit public and

7171 1 governmental entities, the public, and other appropriate
7272 2 persons to assist in developing and implementing the alert
7373 3 system. The Illinois State Police may enter into agreements
7474 4 with participants in the alert system to provide necessary
7575 5 support for the alert system.
7676 6 (d) Upon the request of a local law enforcement agency
7777 7 regarding an active shooter, the Illinois State Police shall
7878 8 activate the alert system in a 50-mile radius of the active
7979 9 shooter's location and notify appropriate participants in the
8080 10 alert system as established by rule if the local law
8181 11 enforcement agency:
8282 12 (1) believes an active shooter is in the agency's
8383 13 jurisdiction;
8484 14 (2) determines an active shooter alert would assist
8585 15 individuals near the active shooter's location;
8686 16 (3) verifies the active shooter situation through a
8787 17 preliminary investigation; and
8888 18 (4) provides the Illinois State Police with the active
8989 19 shooter's last known location and any identifiable
9090 20 information for the active shooter.
9191 21 The Illinois State Police may modify the criteria
9292 22 described by this subsection as necessary for the proper
9393 23 implementation of the alert system.
9494 24 (e) Before requesting activation of the alert system, a
9595 25 local law enforcement agency must verify that the criteria
9696 26 described in subsection (d) have been satisfied. Upon

107107 1 verification of the applicable criteria, the local law
108108 2 enforcement agency may immediately contact the Illinois State
109109 3 Police to request activation and supply the necessary
110110 4 information in a manner prescribed by the coordinator.
111111 5 (f) A State agency participating in the alert system
112112 6 shall:
113113 7 (1) cooperate with the Illinois State Police and
114114 8 assist in developing and implementing the alert system;
115115 9 and
116116 10 (2) establish a plan for providing relevant
117117 11 information to its officers, investigators, or employees,
118118 12 as appropriate, on activation of the alert system.
119119 13 (g) In addition to its other duties prescribed in this
120120 14 Section, the Illinois Department of Transportation shall
121121 15 establish a plan for providing relevant information to the
122122 16 public within 50 miles of an active shooter for which an alert
123123 17 has been issued through an existing system of dynamic message
124124 18 signs located across the State.
125125 19 (h) The Director shall terminate any activation of the
126126 20 alert system for a particular active shooter if:
127127 21 (1) the active shooter situation is resolved; or
128128 22 (2) the Director determines the alert system is no
129129 23 longer an effective tool for providing relevant
130130 24 information to the public about the active shooter.
131131 25 As soon as practicable after the effective date of this
132132 26 amendatory Act of the 103rd General Assembly, the Illinois

143143 1 State Police shall adopt rules and issue directives necessary

145145 3 Section 10. The Department of Transportation Law of the
146146 4 Civil Administrative Code of Illinois is amended by adding
147147 5 Section 2705-625 as follows:

149149 7 Sec. 2705-625. Illinois active shooter alert system. The
150150 8 Department of Transportation shall perform the duties
151151 9 prescribed to it in Section 2605-490 of the Illinois State
152152 10 Police Law of the Civil Administrative Code of Illinois.
153153 11 Section 99. Effective date. This Act takes effect upon
154154 12 becoming law.
