Sosnowski SYNOPSIS AS INTRODUCED:  20 ILCS 2605/2605-490 new20 ILCS 2705/2705-625 new  Amends the Illinois State Police Law of the Civil Administrative Code of Illinois. Provides that the Illinois State Police, with cooperation of the Governor, the Illinois Department of Transportation, any other appropriate State agency, and State or local police and public safety agencies, shall develop and implement an alert system to be activated on report of an active shooter. Provides that the Director of the Illinois State Police shall be the statewide coordinator of the alert system. Provides that the coordinator shall adopt rules and issue directives as necessary to ensure proper implementation of the alert system. Provides that the rules and directives shall prescribe procedures for local law enforcement agencies requesting activation of the alert system. Provides that the Illinois State Police shall recruit public and commercial television and radio broadcasters, mobile telephone service providers, private commercial entities, State or local governmental entities, the public, and other appropriate persons to assist in developing and implementing the alert system. 1  AN ACT concerning State government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois State Police Law of the Civil
5  Administrative Code of Illinois is amended by adding Section
6  2605-490 as follows:

8  Sec. 2605-490. Illinois active shooter alert system.
9  (a) The Illinois State Police, with the cooperation of the
10  Governor, the Illinois Department of Transportation, any other
11  appropriate State agency, and State or local police and public
12  safety agencies, shall develop and implement an alert system
13  to be activated upon the report of an active shooter.
14  (b) The Director of the Illinois State Police shall be the
15  statewide coordinator of the alert system. The coordinator
16  shall adopt rules and issue directives as necessary to ensure
17  proper implementation of the alert system. The rules and
18  directives shall prescribe procedures for local law
19  enforcement agencies to request activation of the alert
20  system.

1  governmental entities, the public, and other appropriate
2  persons to assist in developing and implementing the alert
3  system. The Illinois State Police may enter into agreements
4  with participants in the alert system to provide necessary
5  support for the alert system.
6  (d) Upon the request of a local law enforcement agency
7  regarding an active shooter, the Illinois State Police shall
8  activate the alert system in a 50-mile radius of the active
9  shooter's location and notify appropriate participants in the
10  alert system as established by rule if the local law
11  enforcement agency:
12  (1) believes an active shooter is in the agency's
13  jurisdiction;
14  (2) determines an active shooter alert would assist
15  individuals near the active shooter's location;
16  (3) verifies the active shooter situation through a
17  preliminary investigation; and
18  (4) provides the Illinois State Police with the active
19  shooter's last known location and any identifiable
20  information for the active shooter.
21  The Illinois State Police may modify the criteria
22  described by this subsection as necessary for the proper
23  implementation of the alert system.
24  (e) Before requesting activation of the alert system, a
25  local law enforcement agency must verify that the criteria
26  described in subsection (d) have been satisfied. Upon

1  verification of the applicable criteria, the local law
2  enforcement agency may immediately contact the Illinois State
3  Police to request activation and supply the necessary
4  information in a manner prescribed by the coordinator.
5  (f) A State agency participating in the alert system
6  shall:
7  (1) cooperate with the Illinois State Police and
8  assist in developing and implementing the alert system;
9  and
10  (2) establish a plan for providing relevant
11  information to its officers, investigators, or employees,
12  as appropriate, on activation of the alert system.
13  (g) In addition to its other duties prescribed in this
14  Section, the Illinois Department of Transportation shall
15  establish a plan for providing relevant information to the
16  public within 50 miles of an active shooter for which an alert
17  has been issued through an existing system of dynamic message
18  signs located across the State.
19  (h) The Director shall terminate any activation of the
20  alert system for a particular active shooter if:
21  (1) the active shooter situation is resolved; or
22  (2) the Director determines the alert system is no
23  longer an effective tool for providing relevant
24  information to the public about the active shooter.
25  As soon as practicable after the effective date of this
26  amendatory Act of the 103rd General Assembly, the Illinois

1  State Police shall adopt rules and issue directives necessary
2  to implement this Section.
3  Section 10. The Department of Transportation Law of the
4  Civil Administrative Code of Illinois is amended by adding
5  Section 2705-625 as follows:
6  (20 ILCS 2705/2705-625 new)
7  Sec. 2705-625. Illinois active shooter alert system. The
8  Department of Transportation shall perform the duties
9  prescribed to it in Section 2605-490 of the Illinois State
10  Police Law of the Civil Administrative Code of Illinois.
11  Section 99. Effective date. This Act takes effect upon
12  becoming law.
