311 1 AN ACT concerning safety.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Environmental Protection Act is amended by
715 5 changing Section 22.60 as follows:

1018 8 Sec. 22.60. Pilot project for Will County and Grundy
1119 9 County pyrolysis or gasification facility.
1220 10 (a) As used in this Section:
1321 11 "Plastics" means polystyrene or any other synthetic
1422 12 organic polymer that can be molded into shape under heat and
1523 13 pressure and then set into a rigid or slightly elastic form.
1624 14 "Plastics gasification facility" means a manufacturing
1725 15 facility that:
1826 16 (1) receives only uncontaminated plastics that have
1927 17 been processed prior to receipt at the facility into a
2028 18 feedstock meeting the facility's specifications for a
2129 19 gasification feedstock; and
2230 20 (2) uses heat in an oxygen-deficient atmosphere to
2331 21 process the feedstock into fuels, chemicals, or chemical
2432 22 feedstocks that are returned to the economic mainstream in
2533 23 the form of raw materials or products.

3468 1 "Plastics pyrolysis facility" means a manufacturing
3569 2 facility that:
3670 3 (1) receives only uncontaminated plastics that have
3771 4 been processed prior to receipt at the facility into a
3872 5 feedstock meeting the facility's specifications for a
3973 6 pyrolysis feedstock; and
4074 7 (2) uses heat in the absence of oxygen to process the
4175 8 uncontaminated plastics into fuels, chemicals, or chemical
4276 9 feedstocks that are returned to the economic mainstream in
4377 10 the form of raw materials or products.
4478 11 (b) Provided that permitting and construction has
4579 12 commenced prior to July 1, 2027 2025, a pilot project allowing
4680 13 for a pyrolysis or gasification facility in accordance with
4781 14 this Section is permitted for a locally zoned and approved
4882 15 site in either Will County or Grundy County.
4983 16 (c) To the extent allowed by federal law, uncontaminated
5084 17 plastics that have been processed into a feedstock meeting
5185 18 feedstock specifications for a plastics gasification facility
5286 19 or plastics pyrolysis facility, and that are further processed
5387 20 by such a facility and returned to the economic mainstream in
5488 21 the form of raw materials or products, are considered recycled
5589 22 and are not subject to regulation as waste.
5690 23 (d) The Agency may propose to the Board for adoption, and
5791 24 the Board may adopt, rules establishing standards for
5892 25 materials accepted as feedstocks by plastics gasification
5993 26 facilities and plastics pyrolysis facilities, rules

74108 5 (e) If permitting and construction for the pilot project
75109 6 under subsection (b) has not commenced by July 1, 2027 2025,
76110 7 this Section is repealed.
