12 | 20 | | 10 (a) As used in this Section: |

13 | 21 | | 11 "Plastics" means polystyrene or any other synthetic |
---|
14 | 22 | | 12 organic polymer that can be molded into shape under heat and |
---|
15 | 23 | | 13 pressure and then set into a rigid or slightly elastic form. |
---|
16 | 24 | | 14 "Plastics gasification facility" means a manufacturing |
---|
17 | 25 | | 15 facility that: |
---|
18 | 26 | | 16 (1) receives only uncontaminated plastics that have |
---|
19 | 27 | | 17 been processed prior to receipt at the facility into a |
---|
20 | 28 | | 18 feedstock meeting the facility's specifications for a |
---|
21 | 29 | | 19 gasification feedstock; and |
---|
22 | 30 | | 20 (2) uses heat in an oxygen-deficient atmosphere to |
---|
23 | 31 | | 21 process the feedstock into fuels, chemicals, or chemical |
---|
24 | 32 | | 22 feedstocks that are returned to the economic mainstream in |
---|
25 | 33 | | 23 the form of raw materials or products. |

44 | 78 | | 11 (b) Provided that permitting and construction has |
---|
45 | 79 | | 12 commenced prior to July 1, 2027 2025, a pilot project allowing |
---|
46 | 80 | | 13 for a pyrolysis or gasification facility in accordance with |
---|
47 | 81 | | 14 this Section is permitted for a locally zoned and approved |
---|
48 | 82 | | 15 site in either Will County or Grundy County. |
---|
49 | 83 | | 16 (c) To the extent allowed by federal law, uncontaminated |
---|
50 | 84 | | 17 plastics that have been processed into a feedstock meeting |
---|
51 | 85 | | 18 feedstock specifications for a plastics gasification facility |
---|
52 | 86 | | 19 or plastics pyrolysis facility, and that are further processed |
---|
53 | 87 | | 20 by such a facility and returned to the economic mainstream in |
---|
54 | 88 | | 21 the form of raw materials or products, are considered recycled |
---|
55 | 89 | | 22 and are not subject to regulation as waste. |
---|
56 | 90 | | 23 (d) The Agency may propose to the Board for adoption, and |
---|
57 | 91 | | 24 the Board may adopt, rules establishing standards for |
---|
58 | 92 | | 25 materials accepted as feedstocks by plastics gasification |
---|
59 | 93 | | 26 facilities and plastics pyrolysis facilities, rules |
---|
