11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Animal Welfare Act is amended by changing
15	15	5 Section 3.8 as follows:
16	16	6 (225 ILCS 605/3.8)
17	17	7 Sec. 3.8. Prohibition of dogs, and cats, and rabbits sold
18	18	8 by pet shops; recordkeeping.
19	19	9 (a) A pet shop operator may offer for sale a dog or cat
20	20	10 only if the dog or cat is obtained from an animal control
21	21	11 facility or animal shelter, located in-state or out-of-state,
22	22	12 that is in compliance with Section 3.9.
23	23	13 (b) A pet shop operator shall keep a record of each dog or
24	24	14 cat offered for sale. The record must be kept on file for a
25	25	15 period of 2 years following the acquisition of each dog or cat,
26	26	16 made available to the Department upon request, and submitted
27	27	17 to the Department on May 1 and November 1 of each year. The
28	28	18 record shall include the following:
29	29	19 (1) name, address, and phone number of the animal
30	30	20 control facility or animal shelter each dog or cat was
31	31	21 obtained from; and
32	32	22 (2) documentation from the animal control facility or
33	33	23 animal shelter each dog or cat was obtained from

68	68	1 demonstrating compliance with Section 3.9, including the
69	69	2 circumstances that led to the animal control facility or
70	70	3 animal shelter obtaining ownership of the dog or cat and
71	71	4 any other information indicating the dog or cat was not
72	72	5 obtained from a source prohibited in Section 3.9.
73	73	6 (c) In addition to the penalties set forth in Section
74	74	7 20.5, a pet shop operator that violates subsection (a) shall
75	75	8 no longer offer for sale a dog or cat regardless of where the
76	76	9 dog or cat was obtained.
77	77	10 (d) Nothing in this Section prohibits a pet shop operator
78	78	11 from providing space to an animal control facility or animal
79	79	12 shelter to showcase dogs or cats owned by these entities for
80	80	13 the purpose of adoption.
81	81	14 (e) A pet shop operator shall not offer for sale a rabbit
82	82	15 regardless of where it was obtained.
