1414 1 AN ACT concerning transportation.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Vehicle Code is amended by
1818 5 changing Sections 1-146 and 1-217 and by adding Sections
1919 6 1-140.11 and 11-1518 as follows:
2020 7 (625 ILCS 5/1-140.11 new)
2121 8 Sec. 1-140.11. Low-speed electric scooter. A device
2222 9 weighing less than 100 pounds, with 2 or 3 wheels, handlebars,
2323 10 and a floorboard that can be stood upon while riding, that is
2424 11 solely powered by an electric motor and human power, and whose
2525 12 maximum speed, with or without human propulsion on a paved
2626 13 level surface, is no more than 20 miles per hour. "Low-speed
2727 14 electric scooter" does not include a moped, motor-driven
2828 15 cycle, motor vehicle, or vehicle.

3030 17 Sec. 1-146. Motor vehicle. Every vehicle which is
3131 18 self-propelled and every vehicle which is propelled by

3434 21 power, motorized wheelchairs, low-speed electric bicycles,

7676 1 this Act, motor vehicles are divided into two divisions:
7777 2 First Division: Those motor vehicles which are designed

8888 13 Sec. 1-217. Vehicle. Every device, in, upon or by which
8989 14 any person or property is or may be transported or drawn upon a
9090 15 highway or requiring a certificate of title under Section
9191 16 3-101(d) of this Code, except devices moved by human power,
9292 17 low-speed electric scooters, devices used exclusively upon
9393 18 stationary rails or tracks and snowmobiles as defined in the
9494 19 Snowmobile Registration and Safety Act.
9595 20 For the purposes of this Code, unless otherwise
9696 21 prescribed, a device shall be considered to be a vehicle until
9797 22 such time it either comes within the definition of a junk
9898 23 vehicle, as defined under this Code, or a junking certificate
9999 24 is issued for it.

123123 13 Sec. 11-1518. Low-speed electric scooters.
124124 14 (a) A person may operate a low-speed electric scooter
125125 15 where the operation of bicycles is permitted, including, but
126126 16 not limited to, bicycle lanes and bicycle paths, and shall
127127 17 have all of the rights and shall be subject to all of the
128128 18 duties applicable to the rider of a bicycle under this
129129 19 Chapter, except as otherwise provided in this Section, and
130130 20 except for provisions that by their nature can have no
131131 21 application, including subsection (a) of Section 11-1503.
132132 22 (b) A person may not operate a low-speed electric scooter
133133 23 without a driver's license, instruction permit, or State
134134 24 identification card.
135135 25 (c) A person may not operate a low-speed electric scooter

146146 1 unless he or she is 16 years of age or older.
147147 2 (d) A low-speed electric scooter may be parked in the same
148148 3 manner and at the same locations as a bicycle may be parked.
149149 4 (e) Every low-speed electric scooter when in use at
150150 5 nighttime shall be equipped with a lamp on the front that emits
151151 6 a white light visible from a distance of at least 500 feet to
152152 7 the front and with a red reflector on the rear that is visible
153153 8 from all distances from 100 feet to 600 feet to the rear when
154154 9 directly in front of lawful lower beams of headlamps on a motor
155155 10 vehicle, except that a lamp emitting a steady or flashing red
156156 11 light visible from a distance of 500 feet to the rear may be
157157 12 used in addition to or instead of the red reflector.
158158 13 (f) A low-speed electric scooter shall not be equipped
159159 14 with nor shall any person use upon a low-speed electric
160160 15 scooter any siren. This subsection does not apply to a
161161 16 low-speed electric scooter that is a police vehicle or fire
162162 17 department vehicle.
163163 18 (g) Every low-speed electric scooter shall be equipped
164164 19 with a brake that will adequately control movement of and stop
165165 20 and hold the low-speed electric scooter.
166166 21 Section 99. Effective date. This Act takes effect upon
167167 22 becoming law.
