1515 1 AN ACT concerning civil law.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Biometric Information Privacy Act is
1919 5 amended by changing Sections 10, 15, and 25 and by adding
2020 6 Section 35 as follows:

2222 8 Sec. 10. Definitions. In this Act:
2323 9 "Biometric identifier" means a retina or iris scan,
2424 10 fingerprint, voiceprint, or scan of hand or face geometry.
2525 11 Biometric identifiers do not include writing samples, written
2626 12 signatures, photographs, human biological samples used for
2727 13 valid scientific testing or screening, demographic data,
2828 14 tattoo descriptions, or physical descriptions such as height,
2929 15 weight, hair color, or eye color. Biometric identifiers do not
3030 16 include donated organs, tissues, or parts as defined in the
3131 17 Illinois Anatomical Gift Act or blood or serum stored on
3232 18 behalf of recipients or potential recipients of living or
3333 19 cadaveric transplants and obtained or stored by a federally
3434 20 designated organ procurement agency. Biometric identifiers do
3535 21 not include biological materials regulated under the Genetic
3636 22 Information Privacy Act. Biometric identifiers do not include
3737 23 information captured from a patient in a health care setting

8383 4 Biometric identifiers do not include an X-ray, roentgen
8484 5 process, computed tomography, MRI, PET scan, mammography, or
8585 6 other image or film of the human anatomy used to diagnose,
8686 7 prognose, or treat an illness or other medical condition or to
8787 8 further validate scientific testing or screening. Biometric
8888 9 identifiers do not include information captured and converted
8989 10 to a mathematical representation, including, but not limited
9090 11 to, a numeric string or similar method that cannot be used to
9191 12 recreate the biometric identifier.
9292 13 "Biometric information" means any information, regardless
9393 14 of how it is captured, converted, stored, or shared, based on
9494 15 an individual's biometric identifier used to identify an
9595 16 individual. Biometric information does not include information
9696 17 derived from items or procedures excluded under the definition
9797 18 of biometric identifiers.
9898 19 "Biometric lock" means a device that is used to grant
9999 20 access to a person and converts the person's biometric
100100 21 identifier or biometric information to a mathematical
101101 22 representation, including, but not limited to, a numeric
102102 23 string or similar method that cannot be used to recreate the
103103 24 person's biometric identifier.
104104 25 "Biometric time clock" means a device that is used for

116116 1 or biometric information to a mathematical representation,
117117 2 including, but not limited to, a numeric string or similar
118118 3 method that cannot be used to recreate the person's biometric
119119 4 identifier.
120120 5 "Confidential and sensitive information" means personal
121121 6 information that can be used to uniquely identify an
122122 7 individual or an individual's account or property. Examples of
123123 8 confidential and sensitive information include, but are not
124124 9 limited to, a genetic marker, genetic testing information, a
125125 10 unique identifier number to locate an account or property, an
126126 11 account number, a PIN number, a pass code, a driver's license
127127 12 number, or a social security number.
128128 13 "Electronic signature" means a signature in electronic
129129 14 form attached to or logically associated with an electronic
130130 15 record.
131131 16 "In writing" includes, but is not limited to, electronic
132132 17 communications or notices.
133133 18 "Private entity" means any individual, partnership,
134134 19 corporation, limited liability company, association, or other
135135 20 group, however organized. A private entity does not include a
136136 21 State or local governmental government agency. A private
137137 22 entity does not include any court of Illinois, a clerk of the
138138 23 court, or a judge or justice thereof.
139139 24 "Security purpose" means for the purpose of preventing or
140140 25 investigating retail theft, fraud, or any other
141141 26 misappropriation or theft of a thing of value. "Security

152152 1 purpose" includes protecting property from trespass,
153153 2 controlling access to property, or protecting any person from
154154 3 harm, including stalking, violence, or harassment, and
155155 4 includes assisting a law enforcement investigation.
156156 5 "Written release" means informed written consent or, in
157157 6 the context of employment, a release executed by an employee
158158 7 as a condition of employment. Written release includes
159159 8 electronic communications, and such a release or communication
160160 9 by electronic signature of the employee as provided under
161161 10 Section 5-120 of the Electronic Commerce Security Act.

164164 13 Sec. 15. Retention; collection; disclosure; destruction.
165165 14 (a) A private entity in possession of biometric
166166 15 identifiers or biometric information must develop a written
167167 16 policy, made available to the public, establishing a retention
168168 17 schedule and guidelines for permanently destroying biometric
169169 18 identifiers and biometric information when the initial purpose
170170 19 for collecting or obtaining such identifiers or information
171171 20 has been satisfied or within 3 years of the individual's last
172172 21 interaction with the private entity, whichever occurs first.
173173 22 Absent a valid warrant or subpoena issued by a court of
174174 23 competent jurisdiction, a private entity in possession of
175175 24 biometric identifiers or biometric information must comply

188188 2 (b) No private entity may collect, capture, purchase,
189189 3 receive through trade, or otherwise obtain a person's or a
190190 4 customer's biometric identifier or biometric information,
191191 5 unless it first:
192192 6 (1) informs the subject or the subject's legally
193193 7 authorized representative in writing that a biometric
194194 8 identifier or biometric information is being collected or
195195 9 stored;
196196 10 (2) informs the subject or the subject's legally
197197 11 authorized representative in writing of the specific
198198 12 purpose and length of term for which a biometric
199199 13 identifier or biometric information is being collected,
200200 14 stored, and used; and
201201 15 (3) receives a written release executed by the subject
202202 16 of the biometric identifier or biometric information or
203203 17 the subject's legally authorized representative.
204204 18 (b-5) If the biometric identifier or biometric information
205205 19 is collected or captured for the same repeated process, the
206206 20 private entity is only required to inform the subject or
207207 21 receive consent pursuant to subsection (b) during the initial
208208 22 collection.
209209 23 (b-10) A private entity may collect, capture, or otherwise
210210 24 obtain a person's or a customer's biometric identifier or
211211 25 biometric information without satisfying the requirements of
212212 26 subsection (b) if:

223223 1 (1) the private entity collects, captures, or
224224 2 otherwise obtains a person's or a customer's biometric
225225 3 identifier or biometric information for a security
226226 4 purpose;
227227 5 (2) the private entity uses the biometric identifier
228228 6 or biometric information only for a security purpose;
229229 7 (3) the private entity retains the biometric
230230 8 identifier or biometric information no longer than is
231231 9 reasonably necessary to satisfy a security purpose; and
232232 10 (4) the private entity documents a process and time
233233 11 frame to delete any biometric information used for the
234234 12 purposes identified in this subsection.
235235 13 (c) No private entity in possession of a biometric
236236 14 identifier or biometric information may sell, lease, trade, or
237237 15 otherwise profit from a person's or a customer's biometric
238238 16 identifier or biometric information.
239239 17 (d) No private entity in possession of a biometric
240240 18 identifier or biometric information may disclose, redisclose,
241241 19 or otherwise disseminate a person's or a customer's biometric
242242 20 identifier or biometric information unless:
243243 21 (1) the subject of the biometric identifier or
244244 22 biometric information or the subject's legally authorized
245245 23 representative consents to the disclosure or redisclosure;
246246 24 (2) the disclosure or redisclosure completes a
247247 25 financial transaction requested or authorized by the
248248 26 subject of the biometric identifier or the biometric

259259 1 information or the subject's legally authorized
260260 2 representative;
261261 3 (3) the disclosure or redisclosure is required by
262262 4 State or federal law or municipal ordinance; or
263263 5 (4) the disclosure is required pursuant to a valid
264264 6 warrant or subpoena issued by a court of competent
265265 7 jurisdiction.
266266 8 (e) A private entity in possession of a biometric
267267 9 identifier or biometric information shall:
268268 10 (1) store, transmit, and protect from disclosure all
269269 11 biometric identifiers and biometric information using the
270270 12 reasonable standard of care within the private entity's
271271 13 industry; and
272272 14 (2) store, transmit, and protect from disclosure all
273273 15 biometric identifiers and biometric information in a
274274 16 manner that is the same as or more protective than the
275275 17 manner in which the private entity stores, transmits, and
276276 18 protects other confidential and sensitive information.

279279 21 Sec. 25. Construction.
280280 22 (a) Nothing in this Act shall be construed to impact the
281281 23 admission or discovery of biometric identifiers and biometric
282282 24 information in any action of any kind in any court, or before
283283 25 any tribunal, board, agency, or person.

294294 1 (b) Nothing in this Act shall be construed to conflict
295295 2 with the X-Ray Retention Act, the federal Health Insurance
296296 3 Portability and Accountability Act of 1996, and the rules
297297 4 promulgated under either Act.
298298 5 (c) Nothing in this Act shall be deemed to apply in any
299299 6 manner to a financial institution or an affiliate of a
300300 7 financial institution that is subject to Title V of the
301301 8 federal Gramm-Leach-Bliley Act of 1999 and the rules
302302 9 promulgated thereunder.
303303 10 (d) Nothing in this Act shall be construed to conflict
304304 11 with the Private Detective, Private Alarm, Private Security,
305305 12 Fingerprint Vendor, and Locksmith Act of 2004 and the rules
306306 13 promulgated thereunder or information captured by an alarm
307307 14 system as defined by that Act installed by a person licensed
308308 15 under that Act and the rules adopted thereunder.
309309 16 (e) Nothing in this Act shall be construed to apply to a
310310 17 contractor, subcontractor, or agent of a State agency or local
311311 18 unit of government when working for that State agency or local
312312 19 unit of government.
313313 20 (f) Nothing in this Act shall be construed to apply to
314314 21 information captured by a biometric time clock or biometric
315315 22 lock that converts a person's biometric identifier or
316316 23 biometric information to a mathematical representation,
317317 24 including, but not limited to, a numeric string or similar
318318 25 method that cannot be used to recreate the person's biometric

338338 9 Sec. 5. Damages; minors; third-party liability.
339339 10 (a) Except as provided in Section 1.2, no common law or
340340 11 statutory right to recover damages from the employer, his
341341 12 insurer, his broker, any service organization that is wholly
342342 13 owned by the employer, his insurer or his broker and that
343343 14 provides safety service, advice or recommendations for the
344344 15 employer or the agents or employees of any of them for injury
345345 16 or death sustained by any employee while engaged in the line of
346346 17 his duty as such employee, other than the compensation herein
347347 18 provided, is available to any employee who is covered by the
348348 19 provisions of this Act, to any one wholly or partially
349349 20 dependent upon him, the legal representatives of his estate,
350350 21 or any one otherwise entitled to recover damages for such
351351 22 injury.
352352 23 However, in any action now pending or hereafter begun to

363363 1 enforce a common law or statutory right to recover damages for
364364 2 negligently causing the injury or death of any employee it is
365365 3 not necessary to allege in the complaint that either the
366366 4 employee or the employer or both were not governed by the
367367 5 provisions of this Act or of any similar Act in force in this
368368 6 or any other State. Moreover, nothing in this Act limits,
369369 7 prevents, or preempts a recovery by an employee under the
370370 8 Biometric Information Privacy Act.
371371 9 Any illegally employed minor or his legal representatives
372372 10 shall, except as hereinafter provided, have the right within 6
373373 11 months after the time of injury or death, or within 6 months
374374 12 after the appointment of a legal representative, whichever
375375 13 shall be later, to file with the Commission a rejection of his
376376 14 right to the benefits under this Act, in which case such
377377 15 illegally employed minor or his legal representatives shall
378378 16 have the right to pursue his or their common law or statutory
379379 17 remedies to recover damages for such injury or death.
380380 18 No payment of compensation under this Act shall be made to
381381 19 an illegally employed minor, or his legal representatives,
382382 20 unless such payment and the waiver of his right to reject the
383383 21 benefits of this Act has first been approved by the Commission
384384 22 or any member thereof, and if such payment and the waiver of
385385 23 his right of rejection has been so approved such payment is a
386386 24 bar to a subsequent rejection of the provisions of this Act.
387387 25 (b) Where the injury or death for which compensation is
388388 26 payable under this Act was caused under circumstances creating

399399 1 a legal liability for damages on the part of some person other
400400 2 than his employer to pay damages, then legal proceedings may
401401 3 be taken against such other person to recover damages
402402 4 notwithstanding such employer's payment of or liability to pay
403403 5 compensation under this Act. In such case, however, if the
404404 6 action against such other person is brought by the injured
405405 7 employee or his personal representative and judgment is
406406 8 obtained and paid, or settlement is made with such other
407407 9 person, either with or without suit, then from the amount
408408 10 received by such employee or personal representative there
409409 11 shall be paid to the employer the amount of compensation paid
410410 12 or to be paid by him to such employee or personal
411411 13 representative including amounts paid or to be paid pursuant
412412 14 to paragraph (a) of Section 8 of this Act.
413413 15 Out of any reimbursement received by the employer pursuant
414414 16 to this Section the employer shall pay his pro rata share of
415415 17 all costs and reasonably necessary expenses in connection with
416416 18 such third-party claim, action or suit and where the services
417417 19 of an attorney at law of the employee or dependents have
418418 20 resulted in or substantially contributed to the procurement by
419419 21 suit, settlement or otherwise of the proceeds out of which the
420420 22 employer is reimbursed, then, in the absence of other
421421 23 agreement, the employer shall pay such attorney 25% of the
422422 24 gross amount of such reimbursement.
423423 25 If the injured employee or his personal representative

435435 1 from the employer any payment on account of such compensation,
436436 2 or to institute proceedings to recover the same, the employer
437437 3 may have or claim a lien upon any award, judgment or fund out
438438 4 of which such employee might be compensated from such third
439439 5 party.
440440 6 In such actions brought by the employee or his personal
441441 7 representative, he shall forthwith notify his employer by
442442 8 personal service or registered mail, of such fact and of the
443443 9 name of the court in which the suit is brought, filing proof
444444 10 thereof in the action. The employer may, at any time
445445 11 thereafter join in the action upon his motion so that all
446446 12 orders of court after hearing and judgment shall be made for
447447 13 his protection. No release or settlement of claim for damages
448448 14 by reason of such injury or death, and no satisfaction of
449449 15 judgment in such proceedings shall be valid without the
450450 16 written consent of both employer and employee or his personal
451451 17 representative, except in the case of the employers, such
452452 18 consent is not required where the employer has been fully
453453 19 indemnified or protected by Court order.
454454 20 In the event the employee or his personal representative
455455 21 fails to institute a proceeding against such third person at
456456 22 any time prior to 3 months before such action would be barred,
457457 23 the employer may in his own name or in the name of the
458458 24 employee, or his personal representative, commence a
459459 25 proceeding against such other person for the recovery of
460460 26 damages on account of such injury or death to the employee, and

471471 1 out of any amount recovered the employer shall pay over to the
472472 2 injured employee or his personal representatives all sums
473473 3 collected from such other person by judgment or otherwise in
474474 4 excess of the amount of such compensation paid or to be paid
475475 5 under this Act, including amounts paid or to be paid pursuant
476476 6 to paragraph (a) of Section 8 of this Act, and costs,
477477 7 attorney's fees and reasonable expenses as may be incurred by
478478 8 such employer in making such collection or in enforcing such
479479 9 liability.
