Provides that by May 1, 2025, all State-funded facilities shall have permanent cooling and dehumidification equipment capable of maintaining a room temperature of 75 degrees Fahrenheit, or 24 degrees Celsius, and 50% relative humidity in all habitable spaces, toilet rooms, and public corridors, when: the outdoor temperature is 84 degrees Fahrenheit, or 28.9 degrees Celsius, or higher; or the heat index reaches or exceeds 80 degrees Fahrenheit, or 26.7 degrees Celsius. Provides that the owner or operator of the State-funded facility shall provide and maintain all fixed cooling systems. Provides that fans that do not produce refrigerated air shall not be considered cooling systems. Defines terms. Effective January 1, 2024. 11	11	1 AN ACT concerning regulation.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 1. Short title. This Act may be cited as the
15	15	5 State-funded Facilities Temperature Control Act.
16	16	6 Section 5. Definitions. In this Act:
17	17	7 "Assisted living establishment" has the meaning given to
18	18	8 it in Section 10 of the Assisted Living and Shared Housing Act.
19	19	9 "Day care center" as the meaning given to it in 89 Ill.
20	20	10 Adm. Code 407.
21	21	11 "Facilities" include: (i) day care centers; (ii) assisted
22	22	12 living establishments that provide services to seniors; (iii)
23	23	13 shared housing establishments that provide services to
24	24	14 seniors; (iv) supportive living facilities that provide
25	25	15 services to seniors; (v) a community living facility as
26	26	16 defined in the Community Living Facilities Licensing Act; and
27	27	17 (vi) a long-term care facility licensed under the Nursing Home
28	28	18 Care Act that provides services to seniors.
29	29	19 "Senior" means a person aged 60 or over.
30	30	20 "Shared housing establishment" has the meaning given to it
31	31	21 in Section 10 of the Assisted Living and Shared Housing Act.
32	32	22 "Supportive living facility" means a facility established
33	33	23 under Section 5-5.01a of the Illinois Public Aid Code.

68	68	1 Section 10. State-funded facilities temperature control.
69	69	2 By May 1, 2025, all State-funded facilities shall have
70	70	3 permanent cooling and dehumidification equipment capable of
71	71	4 maintaining a room temperature of 75 degrees Fahrenheit, or 24
72	72	5 degrees Celsius, and 50% relative humidity in all habitable
73	73	6 spaces, toilet rooms, and public corridors, when:
74	74	7 (1) the outdoor temperature is 84 degrees Fahrenheit,
75	75	8 or 28.9 degrees Celsius, or higher; or
76	76	9 (2) the heat index reaches or exceeds 80 degrees
77	77	10 Fahrenheit, or 26.7 degrees Celsius.
78	78	11 The owner or operator of the State-funded facility shall
79	79	12 provide and maintain all fixed cooling systems. Fans that do
80	80	13 not produce refrigerated air shall not be considered cooling
81	81	14 systems within the meaning of this Section.
82	82	15 Section 99. Effective date. This Act takes effect January
