1515 1 AN ACT concerning State government.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 1. Findings. The General Assembly finds:
1919 5 (1) The Juvenile Diabetes Research Foundation's
2020 6 mission is to improve lives today and tomorrow by
2121 7 accelerating life-changing breakthroughs to cure, prevent,
2222 8 and treat type 1 diabetes and its complications.
2323 9 (2) Type 1 diabetes is an autoimmune disease in which
2424 10 insulin-producing beta cells in the pancreas are
2525 11 mistakenly destroyed by the body's immune system.
2626 12 (3) It is estimated that 64,000 children and adults
2727 13 are diagnosed annually, and 2,100,000 children and adults
2828 14 are expected to be diagnosed with type 1 diabetes by 2040.
2929 15 (4) In addition to accelerating research, the Juvenile
3030 16 Diabetes Research Foundation supports those impacted by
3131 17 type 1 diabetes via community forums, events, and
3232 18 resources in English and Spanish.
3333 19 Section 5. The Illinois Lottery Law is amended by changing
3434 20 Sections 9.3 and 20 and by adding Section 21.15 as follows:

8080 2 (a) Beginning July 1, 2022, except as provided in Sections
8181 3 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and 21.13,
8282 4 and 21.15 of this Law Act and Section 25-70 of the Sports
8383 5 Wagering Act, the Department shall distribute all proceeds of
8484 6 lottery tickets and shares sold in the following priority and
8585 7 manner:
8686 8 (1) The payment of prizes and retailer bonuses.
8787 9 (2) The payment of costs incurred in the operation and
8888 10 administration of the Lottery, including the payment of
8989 11 sums due to the private manager under the management
9090 12 agreement with the Department and including costs of
9191 13 administering the Lottery sports wagering program pursuant
9292 14 to Section 25-70 of the Sports Wagering Act.
9393 15 (3) On the last day of each month or as soon thereafter
9494 16 as possible, the State Comptroller shall direct and the
9595 17 State Treasurer shall transfer from the State Lottery Fund
9696 18 to the Common School Fund the Department's estimate of net
9797 19 lottery proceeds.
9898 20 (4) If an amount in excess of the annual net lottery
9999 21 proceeds is transferred for a fiscal year, then the
100100 22 Department shall offset the monthly transfers of estimated
101101 23 net lottery proceeds during the following fiscal year by
102102 24 that excess amount. If an amount less than the annual net
103103 25 lottery proceeds is transferred for a fiscal year, then

115115 1 following such fiscal year, the Department shall direct
116116 2 the deposit of any remaining annual net lottery proceeds
117117 3 from such fiscal year, subject to payments under
118118 4 paragraphs (1) and (2), into the Common School Fund as
119119 5 soon thereafter as possible.
120120 6 (b) The net lottery proceeds shall be determined by
121121 7 deducting from total annual lottery proceeds the expenditures
122122 8 required by paragraphs (1) and (2) of subsection (a). The
123123 9 total annual lottery proceeds and annual net lottery proceeds
124124 10 shall be determined according to generally accepted accounting
125125 11 principles for governmental entities and verified by an annual
126126 12 fiscal year audit.

129129 15 Sec. 20. State Lottery Fund.
130130 16 (a) There is created in the State Treasury a special fund
131131 17 to be known as the State Lottery Fund. Such fund shall consist
132132 18 of all revenues received from (1) the sale of lottery tickets
133133 19 or shares, (net of commissions, fees representing those
134134 20 expenses that are directly proportionate to the sale of
135135 21 tickets or shares at the agent location, and prizes of less
136136 22 than $600 which have been validly paid at the agent level), (2)
137137 23 application fees, and (3) all other sources including moneys
138138 24 credited or transferred thereto from any other fund or source

191191 6 Sec. 21.15. Scratch-off for type 1 diabetes research,
192192 7 support, education, and awareness.
193193 8 (a) The Department shall offer a special instant
194194 9 scratch-off game for the benefit of the Juvenile Diabetes
195195 10 Research Foundation, Illinois Chapter, type 1 diabetes
196196 11 research, support, education, and awareness. The game shall
197197 12 commence on January 1, 2024 or as soon thereafter, at the
198198 13 discretion of the Director, as is reasonably practical. The
199199 14 operation of the game shall be governed by this Law and any
200200 15 rules adopted by the Department. If any provision of this
201201 16 Section is inconsistent with any other provisions of this Law,
202202 17 then this Section governs.
203203 18 (b) The net revenue from the type 1 diabetes research,
204204 19 support, education, and awareness scratch-off game shall be
205205 20 deposited into the Juvenile Diabetes Research Foundation Fund.
206206 21 Moneys received for the purposes of this Section,
207207 22 including, without limitation, net revenue from the special
208208 23 instant scratch-off game and from gifts, grants, and awards
209209 24 from any public or private entity, must be deposited into the
210210 25 fund.

221221 1 For the purposes of this subsection, "net revenue" means
222222 2 the total amount for which tickets have been sold less the sum
223223 3 of the amount paid out in the prizes and the actual
224224 4 administrative expenses of the Department solely related to
225225 5 the scratch-off game under this Section.
226226 6 (c) During the time that tickets are sold for the type 1
227227 7 diabetes research, support, education, and awareness
228228 8 scratch-off game, the Department shall not unreasonably
229229 9 diminish the efforts devoted to marketing any other instant
230230 10 scratch-off lottery game.
231231 11 (d) The Department may adopt any rules necessary to
232232 12 implement and administer the provisions of this Section.
233233 13 Section 10. The Department of Public Health Act is amended
234234 14 by adding Section 8.5 as follows:

236236 16 Sec. 8.5. Administration of Juvenile Diabetes Research
237237 17 Foundation Fund. The Department shall administer the Juvenile
238238 18 Diabetes Research Foundation Fund. The Department shall pass
239239 19 all of the moneys deposited in the Fund as grants to the
240240 20 Juvenile Diabetes Research Foundation for (i) research,
241241 21 treatment, and awareness of diabetes and (ii) improved
242242 22 diabetes self-management and training. As used in this
243243 23 Section, "diabetes self-management and training" has the same
244244 24 meaning as in subsection (b) of Section 356w of the Illinois
