1  AN ACT concerning State government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 1. Findings. The General Assembly finds:
5  (1) The Juvenile Diabetes Research Foundation's
6  mission is to improve lives today and tomorrow by
7  accelerating life-changing breakthroughs to cure, prevent,
8  and treat type 1 diabetes and its complications.
9  (2) Type 1 diabetes is an autoimmune disease in which
10  insulin-producing beta cells in the pancreas are
11  mistakenly destroyed by the body's immune system.
12  (3) It is estimated that 64,000 children and adults
13  are diagnosed annually, and 2,100,000 children and adults
14  are expected to be diagnosed with type 1 diabetes by 2040.
15  (4) In addition to accelerating research, the Juvenile
16  Diabetes Research Foundation supports those impacted by
17  type 1 diabetes via community forums, events, and
18  resources in English and Spanish.
19  Section 5. The Illinois Lottery Law is amended by changing
20  Sections 9.3 and 20 and by adding Section 21.15 as follows:

1  proceeds.
2  (a) Beginning July 1, 2022, except as provided in Sections
3  21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and 21.13,
4  and 21.15 of this Law Act and Section 25-70 of the Sports
5  Wagering Act, the Department shall distribute all proceeds of
6  lottery tickets and shares sold in the following priority and
7  manner:
8  (1) The payment of prizes and retailer bonuses.
9  (2) The payment of costs incurred in the operation and
10  administration of the Lottery, including the payment of
11  sums due to the private manager under the management
12  agreement with the Department and including costs of
13  administering the Lottery sports wagering program pursuant
14  to Section 25-70 of the Sports Wagering Act.
15  (3) On the last day of each month or as soon thereafter
16  as possible, the State Comptroller shall direct and the
17  State Treasurer shall transfer from the State Lottery Fund
18  to the Common School Fund the Department's estimate of net
19  lottery proceeds.
20  (4) If an amount in excess of the annual net lottery
21  proceeds is transferred for a fiscal year, then the
22  Department shall offset the monthly transfers of estimated
23  net lottery proceeds during the following fiscal year by
24  that excess amount. If an amount less than the annual net
25  lottery proceeds is transferred for a fiscal year, then
26  after the related annual fiscal year audit is completed

1  following such fiscal year, the Department shall direct
2  the deposit of any remaining annual net lottery proceeds
3  from such fiscal year, subject to payments under
4  paragraphs (1) and (2), into the Common School Fund as
5  soon thereafter as possible.
6  (b) The net lottery proceeds shall be determined by
7  deducting from total annual lottery proceeds the expenditures
8  required by paragraphs (1) and (2) of subsection (a). The
9  total annual lottery proceeds and annual net lottery proceeds
10  shall be determined according to generally accepted accounting
11  principles for governmental entities and verified by an annual
12  fiscal year audit.

15  Sec. 20. State Lottery Fund.
16  (a) There is created in the State Treasury a special fund
17  to be known as the State Lottery Fund. Such fund shall consist
18  of all revenues received from (1) the sale of lottery tickets
19  or shares, (net of commissions, fees representing those
20  expenses that are directly proportionate to the sale of
21  tickets or shares at the agent location, and prizes of less
22  than $600 which have been validly paid at the agent level), (2)
23  application fees, and (3) all other sources including moneys
24  credited or transferred thereto from any other fund or source

1  shall be credited to the Common School Fund.
2  (b) The receipt and distribution of moneys under Section
3  21.5 of this Law Act shall be in accordance with Section 21.5.
4  (c) The receipt and distribution of moneys under Section
5  21.6 of this Law Act shall be in accordance with Section 21.6.
6  (d) The receipt and distribution of moneys under Section
7  21.7 of this Law Act shall be in accordance with Section 21.7.
8  (e) The receipt and distribution of moneys under Section
9  21.8 of this Law Act shall be in accordance with Section 21.8.
10  (f) The receipt and distribution of moneys under Section
11  21.9 of this Law Act shall be in accordance with Section 21.9.
12  (g) The receipt and distribution of moneys under Section
13  21.10 of this Law Act shall be in accordance with Section
14  21.10.
15  (h) The receipt and distribution of moneys under Section
16  21.11 of this Law Act shall be in accordance with Section
17  21.11.
18  (i) The receipt and distribution of moneys under Section
19  21.12 of this Law Act shall be in accordance with Section
20  21.12.
21  (j) The receipt and distribution of moneys under Section
22  21.13 of this Law Act shall be in accordance with Section
23  21.13.
24  (j-5) The receipt and distribution of moneys under Section
25  21.15 of this Law shall be in accordance with Section 21.15.

2  Section 25-70 of the Sports Wagering Act.

6  Sec. 21.15. Scratch-off for type 1 diabetes research,
7  support, education, and awareness.
8  (a) The Department shall offer a special instant
9  scratch-off game for the benefit of the Juvenile Diabetes
10  Research Foundation, Illinois Chapter, type 1 diabetes
11  research, support, education, and awareness. The game shall
12  commence on January 1, 2024 or as soon thereafter, at the
13  discretion of the Director, as is reasonably practical. The
14  operation of the game shall be governed by this Law and any
15  rules adopted by the Department. If any provision of this
16  Section is inconsistent with any other provisions of this Law,
17  then this Section governs.
18  (b) The net revenue from the type 1 diabetes research,
19  support, education, and awareness scratch-off game shall be
20  deposited into the Juvenile Diabetes Research Foundation Fund.
21  Moneys received for the purposes of this Section,
22  including, without limitation, net revenue from the special
23  instant scratch-off game and from gifts, grants, and awards
24  from any public or private entity, must be deposited into the
25  fund.

1  For the purposes of this subsection, "net revenue" means
2  the total amount for which tickets have been sold less the sum
3  of the amount paid out in the prizes and the actual
4  administrative expenses of the Department solely related to
5  the scratch-off game under this Section.
6  (c) During the time that tickets are sold for the type 1
7  diabetes research, support, education, and awareness
8  scratch-off game, the Department shall not unreasonably
9  diminish the efforts devoted to marketing any other instant
10  scratch-off lottery game.
11  (d) The Department may adopt any rules necessary to
12  implement and administer the provisions of this Section.
13  Section 10. The Department of Public Health Act is amended
14  by adding Section 8.5 as follows:

16  Sec. 8.5. Administration of Juvenile Diabetes Research
17  Foundation Fund. The Department shall administer the Juvenile
18  Diabetes Research Foundation Fund. The Department shall pass
19  all of the moneys deposited in the Fund as grants to the
20  Juvenile Diabetes Research Foundation for (i) research,
21  treatment, and awareness of diabetes and (ii) improved
22  diabetes self-management and training. As used in this
23  Section, "diabetes self-management and training" has the same
24  meaning as in subsection (b) of Section 356w of the Illinois
