311 1 AN ACT concerning State government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 1. Short title. This Act may be cited as the
7-5 Mechanical Insulation Energy and Safety Assessment Act.
15+5 Mechanical Insulation Energy Audit Act.
816 6 Section 5. Legislative findings. The General Assembly
9-7 finds that the State has an interest in decreasing the carbon
10-8 footprint of publicly owned buildings. The General Assembly
11-9 also finds that it is the public policy of this State to ensure
12-10 that all Illinois residents can use publicly owned buildings
13-11 for employment, educational purposes, and social services,
14-12 free from harmful mold and bacteria. This Act is created in
15-13 recognition of the important role that mechanical insulation
16-14 plays in lowering operating expenses, reducing energy loss,
17-15 and decreasing emissions.
18-16 Section 10. Definitions. As used in this Act:
19-17 "Board" means the Capital Development Board.
20-18 "Mechanical insulation" means insulation materials,
21-19 facings, and accessory products that are applied to mechanical
22-20 systems including piping, equipment, vessels, HVAC, boilers,
23-21 and other similar equipment including maintenance on cooling
24-22 system piping for corrosion of equipment.
17+7 finds:
18+8 (1) The State has a vested interest in decreasing the
19+9 carbon footprint of publicly owned buildings.
20+10 (2) It is the public policy of this State to ensure
21+11 that publicly owned buildings in the State are free from
22+12 harmful mold and bacteria and can be used by Illinois
23+13 residents for employment, education, and social services.
24+14 (3) Mechanical insulation plays an important role in
25+15 advancing Illinois toward its clean energy goals by
26+16 lowering operating expenses, reducing energy loss, and
27+17 decreasing emissions.
28+18 Section 10. Definitions. As used in this Act:
29+19 "Agency" means the Environmental Protection Agency.
30+20 "Mechanical insulation" means insulation materials,
31+21 facings, and accessory products applied to mechanical systems,
32+22 such as piping, equipment, vessels, HVAC systems, boilers, and

33-1 "Mechanical insulation energy and safety assessment" means
34-2 an assessment that analyzes potential energy savings and any
35-3 potential public health risks according to the specifications
36-4 of a building's mechanical equipment.
37-5 "Public building" means any structure in the State that is
38-6 owned in whole or in part by the State of Illinois.
39-7 "Qualified mechanical insulation contractor" means a
40-8 mechanical insulation contractor who is an active participant
41-9 in an apprenticeship program approved by the United States
42-10 Department of Labor.
43-11 Section 15. Mechanical insulation energy and safety
44-12 assessments.
45-13 (a) For the purpose of moving the State closer to its 100%
46-14 clean energy goal, the Board shall contract with a qualified
47-15 mechanical insulation contractor on a commission basis to
48-16 perform a mechanical insulation energy and safety assessment
49-17 of every public building within 10 years after the effective
50-18 date of this Act. The assessments' findings shall include any
51-19 and all remediation measures necessary to bring the subject
52-20 mechanical insulation system up to Code, as defined in Section
53-21 10 of the Energy Efficient Building Act, and to ensure that the
54-22 system functions at a specific operating temperature to
55-23 minimize energy loss and ensure public health and safety.
56-24 (b) The findings shall be a matter of public record and
57-25 shall be posted on the Board's website no later than 30 days

68-1 after the completion of the assessment. In addition, the Board
69-2 shall file with the General Assembly an annual report
70-3 outlining the assessments completed in the previous calendar
71-4 year. The reports shall be filed by December 31 of the calendar
72-5 year after the calendar year in which the assessment is
73-6 performed.
74-7 (c) If the mechanical insulation energy and safety
75-8 assessment identifies mechanical insulation remediation
76-9 measures that would result in a reduction in the carbon
77-10 footprint for the subject building of more than 30% and a
78-11 cumulative energy savings for the subject building of more
79-12 than 30%, then the State shall enter into a contract for those
80-13 mechanical insulation remediation measures within 12 months
81-14 after the publication of the assessment findings on the
82-15 Board's website. If any public health or safety concerns are
83-16 identified in the mechanical insulation energy and safety
84-17 assessment, then those concerns are deemed to be a hazard to
85-18 the public health and safety and shall be contracted out for
86-19 immediate remediation. Any construction performed under this
87-20 subsection, as well as any ancillary construction performed
88-21 during the remediation process, shall be subject to the
89-22 Prevailing Wage Act.

68+2 "Mechanical insulation energy audit" means an audit that

73+7 leased by the State, a unit of local government, or any other
74+8 political subdivision of the State.
75+9 Section 15. Mechanical insulation energy audit. The Agency

77+11 public building within the State within 10 years after the
78+12 effective date of this Act. Each mechanical insulation energy
79+13 audit report shall identify remediation measures necessary to

83+17 building's mechanical systems function at operating

86+20 Section 20. Public access of findings; report.
87+21 (a) Mechanical insulation energy audit reports shall be a
88+22 matter of public record and shall be posted on the Agency's

101+1 thereafter, the Agency shall deliver to the General Assembly

104+4 Section 25. Repeal. This Act is repealed on December 31,
