312 1 AN ACT concerning liquor.
413 2 Be it enacted by the People of the State of Illinois,
514 3 represented in the General Assembly:
615 4 Section 5. The Liquor Control Act of 1934 is amended by
7-5 changing Section 6-35 as follows:
8-6 (235 ILCS 5/6-35)
9-7 Sec. 6-35. Alcopops.
10-8 (a) For purposes of this Section: ,
11-9 "Alcopop alcopop" means a flavored alcoholic beverage or
12-10 flavored malt beverage that includes (i) a malt beverage
13-11 containing a malt base or beer and added natural or artificial
14-12 blending material, such as fruit juices, flavors, flavorings,
15-13 colorings, or preservatives where the beverage constitutes
16-14 0.5% or more of alcohol by volume such blending material
17-15 constitutes .5% or more of the alcohol by volume contained in
18-16 the finished beverage; (ii) a beverage containing wine and
19-17 more than 15% added natural or artificial blending material,
20-18 such as fruit juices, flavors, flavorings, or adjuncts, water
21-19 (plain, carbonated, or sparkling), colorings, or
22-20 preservatives; (iii) a beverage containing distilled alcohol
23-21 and added natural or artificial blending material, such as
24-22 fruit juices, flavors, flavorings, colorings, or
25-23 preservatives; or (iv) an alcohol malt beverage containing

18+7 Sec. 6-6.3. Non-alcoholic merchandise.
19+8 (a) Nothing in this Act shall authorize the Illinois
20+9 Liquor Control Commission to regulate or exercise jurisdiction
21+10 over any action, transaction, and business of manufacturers,
22+11 distributors, or retailers, or any parent or subsidiary
23+12 thereof, engaged in any transaction involving the furnishing,
24+13 selling, or offering for sale of non-alcoholic merchandise by
25+14 manufacturers, distributors, or retailers, or any parent or
26+15 subsidiary thereof, unless the transaction involves expressed
27+16 or implied agreements or understandings prohibited by this
28+17 Act.
29+18 (b) Non-alcoholic merchandise may be sold by a
30+19 manufacturer class license holder, non-resident dealer,
31+20 foreign importer, importing distributor, or distributor, or
32+21 any parent or subsidiary thereof, to a retail licensee if:
33+22 (1) the manufacturer class license holder,
34+23 non-resident dealer, foreign importer, importing

34-1 caffeine, guarana, taurine, or ginseng, where the beverage
35-2 constitutes 0.5% or more of alcohol by volume.
36-3 "Immediately adjacent" means directly touching or
37-4 immediately bordering one another from above, below, or the
38-5 side. "Immediately adjacent" does not include a separate
39-6 aisle.
40-7 "Retail sales floor" means the part of a retailer's
41-8 premises that contains goods on display that are freely
42-9 accessible to the consumer
43-10 (b) No entity may advertise, promote, or market any
44-11 alcopop beverages toward children. Advertise, promote, or
45-12 market includes, but is not limited to the following:
46-13 (1) the use of cartoons and youth-orientated photos in
47-14 advertising, promotion, packaging, or labeling of alcohol
48-15 products;
49-16 (2) sponsorships of athletic events where the intended
50-17 audience is primarily children;
51-18 (3) billboards advertising alcopops, as defined in
52-19 items (i), (ii), and (iii) of subsection (a) of this
53-20 Section, placed within 500 feet of schools, public parks,
54-21 amusement parks, and places of worship; and
55-22 (4) the display of any alcopop beverage in any
56-23 videogame, theater production, or other live performances
57-24 where the intended audience is primarily children.
58-25 (b-5) No retail establishment with a retail sales floor
59-26 that exceeds 2,500 square feet shall display alcopops

70-1 immediately adjacent to soft drinks, fruit juices, bottled

73-4 (b-10) Any retail establishment with a retail sales floor
74-5 that is equal to or less than 2,500 square feet shall either:
75-6 (1) not display alcopops immediately adjacent to soft
76-7 drinks, fruit juices, bottled water, candy, or snack foods
77-8 portraying cartoons or youth-oriented photos; or
78-9 (2) equip any such display that contains alcopops and
79-10 is immediately adjacent to soft drinks, fruit juices,
80-11 bottled water, candy, or snack foods portraying cartoons
81-12 or youth-oriented photos with signage that is clearly
82-13 visible to consumers, is not less than 8.5 x 11 inches, and
83-14 states the following: "This product is an alcoholic
84-15 beverage available only to persons who are 21
85- years of age
86-16 or older.". Such sign may be provided by the State
87-17 Commission or by the licensee.
88-18 (b-15) Subsections (b-5) and (b-10) do not apply to a
89-19 shelf, aisle, display, or display area in which the primary
90-20 items for sale are alcoholic liquors or in an area in which
91-21 persons under the age of 21 are prohibited from entering
92-22 without a parent or legal guardian.
93-23 (c) No entity shall sell for consumption an alcohol malt
94-24 beverage containing caffeine, guarana, taurine, or ginseng,
95-25 where the beverage constitutes 0.5% or more of alcohol by
96-26 volume, unless individual containers of the beverage have

110-4 (d) Any person who violates this Section is guilty of a
111-5 business offense and shall be fined $500 for a first offense
112-6 and $1,000 for a second or subsequent offense.
113-7 (e) Nothing in this Section shall be construed to be
114-8 inconsistent with any other provision of this Section or any
115-9 other State or federal laws, rules, or regulations regarding
116-10 the labeling of alcoholic beverages.

71+1 distributor, or distributor, or any parent or subsidiary
72+2 thereof, is also in business as a bona fide producer or
73+3 vendor of other merchandise;
74+4 (2) the merchandise is sold at its fair market value;
75+5 (3) the non-alcoholic merchandise is not sold in
76+6 combination with alcoholic liquor or conditioned on the
77+7 sale of alcoholic liquor;
78+8 (4) the manufacturer class license holder's,
79+9 non-resident dealer's, foreign importer's, importing
80+10 distributor's, or distributor's, or their parent's or
81+11 subsidiary's, acquisition or production costs of the
82+12 non-alcoholic merchandise appear on the manufacturer class
83+13 license holder's, non-resident dealer's, foreign
84+14 importer's, importing distributor's, or distributor's
85+15 purchase invoices or other records;
86+16 (5) the individual selling prices of the non-alcoholic
87+17 merchandise and alcoholic liquor sold in a single
88+18 transaction can be determined from commercial documents
89+19 covering the sales transaction if non-alcoholic
90+20 merchandise is sold in the same transaction as alcoholic
91+21 liquor; and
92+22 (6) the price is collected by the manufacturer class
93+23 license holder, non-resident dealer, foreign importer, or
94+24 distributor, or any parent or subsidiary thereof, within
95+25 30 days of the date of the sale, unless other terms are
96+26 established in writing between the parties.

107+1 (c) The State Commission may not prohibit the sale of
108+2 non-alcoholic merchandise if it is sold in the manner in which
109+3 the non-alcoholic merchandise is sold by a manufacturer or
110+4 distributor that is not licensed by the State Commission;
111+5 provided, however, that all invoices for non-alcoholic
112+6 merchandise sold by a manufacturer class license holder,
113+7 non-resident dealer, foreign importer, importing distributor,
114+8 or distributor, or any parent or subsidiary thereof, that is
115+9 also in business as a bona fide producer or vendor of other
116+10 merchandise must be in compliance with the books and records
117+11 requirements of 11 Ill. Adm. Code 100.130. If the
118+12 non-alcoholic merchandise is sold on the same invoice as an
119+13 alcoholic liquor product, the 30-day merchandising credit
120+14 provisions of Section 6-5 of this Act shall apply to the entire
121+15 transaction, including the non-alcoholic merchandise.
122+16 (d) Except as provided in subsection (f), a manufacturer
123+17 class license holder, non-resident dealer, foreign importer,
124+18 importing distributor, or distributor, or any parent or
125+19 subsidiary thereof, that is also in business as a bona fide
126+20 producer or vendor of non-alcoholic merchandise shall not
127+21 condition the sale of its alcoholic liquor on the sale of its
128+22 non-alcoholic merchandise and shall not combine the sale of
129+23 its alcoholic liquor with the sale of its non-alcoholic
130+24 merchandise. A manufacturer class license holder, non-resident
131+25 dealer, foreign importer, importing distributor, or
132+26 distributor, or any parent or subsidiary thereof, that is also

144+2 merchandise may sell, market, and promote non-alcoholic
145+3 merchandise in the same manner in which the non-alcoholic
146+4 merchandise is sold, marketed, or promoted by a manufacturer
147+5 or distributor not licensed by the State Commission.
148+6 Notwithstanding any provision of this Section to the contrary,
149+7 the bona fide producer or vendor of non-alcoholic merchandise
150+8 shall not provide something of value to a retailer for sale of
151+9 non-alcoholic merchandise if the of-value item or items are a
152+10 subterfuge for providing something of value for the sale of
153+11 alcoholic liquor. The State Commission shall have the
154+12 authority to examine records of a manufacturer class license
155+13 holder, non-resident dealer, foreign importer, importing
156+14 distributor, or distributor, or any parent or subsidiary
157+15 thereof, for the purpose of examining all of-value
158+16 transactions between such entity and a retailer.
159+17 (e) Notwithstanding the prohibited furnishing or providing
160+18 of fixtures, equipment, and furnishings to retailers as
161+19 contained in Section 6-6 of this Act, the act of a manufacturer
162+20 class license holder, non-resident dealer, foreign importer,
163+21 importing distributor, or distributor furnishing or providing
164+22 retailers with fixtures, equipment, or furnishings for the
165+23 limited purpose of storing, servicing, displaying,
166+24 advertising, furnishing, selling, or aiding in the sale of
167+25 non-alcoholic merchandise is permitted, only to the extent
168+26 allowed by this Section, and such fixtures, equipment, and

179+1 furnishings shall not be used by the retail licensee to store,
180+2 service, display, advertise, furnish, sell, or aid in the sale
181+3 of alcoholic liquors. All such fixtures, equipment, or
182+4 furnishings shall be identified by the retail licensee as
183+5 being furnished by a manufacturer class license holder,
184+6 non-resident dealer, foreign importer, importing distributor,
185+7 or distributor licensed by the State Commission and, if
186+8 purchased by the retail licensee and sold on the same invoice
187+9 as alcoholic liquor products, the price must be collected by
188+10 the manufacturer class license holder, non-resident dealer,
189+11 foreign importer, importing distributor, or distributor
190+12 selling the same within 30 days of the date of sale.
191+13 (f) Notwithstanding any provision of this Act to the
192+14 contrary, a manufacturer class license holder, non-resident
193+15 dealer, foreign importer, importing distributor, or
194+16 distributor may package and distribute alcoholic liquor in
195+17 combination with other non-alcoholic merchandise products if
196+18 the alcoholic liquor and non-alcoholic merchandise was
197+19 originally packaged together for ultimate sale to consumers by
198+20 the manufacturer or agent of the manufacturer as originally
199+21 packaged by the manufacturer or agent of the manufacturer for
200+22 ultimate sale to consumers.

214+1 (a) For purposes of this Section, "alcopop" means a

260+11 paragraph (5) shall not apply to a shelf, aisle, or
261+12 display area in which the primary items for sale are
262+13 alcoholic liquors or an area in which persons under the
263+14 age of 21 are prohibited from entering without a parent or
264+15 legal guardian.
265+16 In this paragraph (5), an alcopop is adjacent if
266+17 placed:
267+18 (A) on the same shelf or aisle of shelves as soft
268+19 drinks, fruit juices, bottled water, candy, or snack
269+20 foods portraying cartoons or youth-orientated photos;
270+21 (B) on the same display or abutting display that
271+22 also displays soft drinks, fruit juices, bottled
272+23 water, candy, or snack foods portraying cartoons or
273+24 youth-orientated photos;
274+25 (C) on an end cap display or a display at the end
275+26 of a shelving row that contains soft drinks, fruit

287+2 portraying cartoons or youth-orientated photos;
288+3 (D) on a display at or near an area that primarily
289+4 displays soft drinks, fruit juices, bottled water,
290+5 candy, or snack foods portraying cartoons or
291+6 youth-orientated photos; or
292+7 (E) in the same or abutting refrigeration unit
293+8 that also displays soft drinks, fruit juices, bottled
294+9 water, candy, or snack foods portraying cartoons or
295+10 youth-orientated photos.
296+11 (c) No entity shall sell for consumption an alcohol malt
297+12 beverage containing caffeine, guarana, taurine, or ginseng,
298+13 where the beverage constitutes 0.5% or more of alcohol by
299+14 volume, unless individual containers of the beverage have
300+15 imprinted on each individual container the following:
301+16 (1) the words "contains alcohol"; and
302+17 (2) the alcohol content of the beverage.
303+18 (d) Any person who violates this Section is guilty of a
304+19 business offense and shall be fined $500 for a first offense
305+20 and $1,000 for a second or subsequent offense.
