1212 1 AN ACT concerning courts.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Freedom of Information Act is amended by
1616 5 changing Section 2 as follows:
1717 6 (5 ILCS 140/2) (from Ch. 116, par. 202)
1818 7 Sec. 2. Definitions. As used in this Act:
1919 8 (a) "Public body" means all legislative, executive,
2020 9 administrative, or advisory bodies of the State, state
2121 10 universities and colleges, counties, townships, cities,
2222 11 villages, incorporated towns, school districts and all other
2323 12 municipal corporations, boards, bureaus, committees, or
2424 13 commissions of this State, any subsidiary bodies of any of the
2525 14 foregoing including but not limited to committees and
2626 15 subcommittees thereof, and a School Finance Authority created
2727 16 under Article 1E of the School Code. "Public body" does not
2828 17 include a child death review team or the Illinois Child Death
2929 18 Review Teams Executive Council established under the Child
3030 19 Death Review Team Act, or a regional youth advisory board or
3131 20 the Statewide Youth Advisory Board established under the
3232 21 Department of Children and Family Services Statewide Youth
3333 22 Advisory Board Act.
3434 23 (b) "Person" means any individual, corporation,

7171 1 partnership, firm, organization or association, acting

7373 3 (c) "Public records" means all records, reports, forms,
7474 4 writings, letters, memoranda, books, papers, maps,
7575 5 photographs, microfilms, cards, tapes, recordings, electronic
7676 6 data processing records, electronic communications, recorded
7777 7 information and all other documentary materials pertaining to
7878 8 the transaction of public business, regardless of physical
7979 9 form or characteristics, having been prepared by or for, or
8080 10 having been or being used by, received by, in the possession
8181 11 of, or under the control of any public body.
8282 12 (c-5) "Private information" means unique identifiers,
8383 13 including a person's social security number, driver's license
8484 14 number, employee identification number, biometric identifiers,
8585 15 personal financial information, passwords or other access
8686 16 codes, medical records, home or personal telephone numbers,
8787 17 and personal email addresses. Private information also
8888 18 includes home address and personal license plates, except as
8989 19 otherwise provided by law or when compiled without possibility
9090 20 of attribution to any person.
9191 21 (c-10) "Commercial purpose" means the use of any part of a
9292 22 public record or records, or information derived from public
9393 23 records, in any form for sale, resale, or solicitation or
9494 24 advertisement for sales or services. For purposes of this
9595 25 definition, requests made by news media and non-profit,
9696 26 scientific, or academic organizations shall not be considered

107107 1 to be made for a "commercial purpose" when the principal
108108 2 purpose of the request is (i) to access and disseminate
109109 3 information concerning news and current or passing events,
110110 4 (ii) for articles of opinion or features of interest to the
111111 5 public, or (iii) for the purpose of academic, scientific, or
112112 6 public research or education.
113113 7 (d) "Copying" means the reproduction of any public record
114114 8 by means of any photographic, electronic, mechanical or other
115115 9 process, device or means now known or hereafter developed and
116116 10 available to the public body.
117117 11 (e) "Head of the public body" means the president, mayor,
118118 12 chairman, presiding officer, director, superintendent,
119119 13 manager, supervisor or individual otherwise holding primary
120120 14 executive and administrative authority for the public body, or
121121 15 such person's duly authorized designee.
122122 16 (f) "News media" means a newspaper or other periodical
123123 17 issued at regular intervals whether in print or electronic
124124 18 format, a news service whether in print or electronic format,
125125 19 a radio station, a television station, a television network, a
126126 20 community antenna television service, or a person or
127127 21 corporation engaged in making news reels or other motion
128128 22 picture news for public showing.
129129 23 (g) "Recurrent requester", as used in Section 3.2 of this
130130 24 Act, means a person that, in the 12 months immediately
131131 25 preceding the request, has submitted to the same public body
132132 26 (i) a minimum of 50 requests for records, (ii) a minimum of 15

143143 1 requests for records within a 30-day period, or (iii) a
144144 2 minimum of 7 requests for records within a 7-day period. For
145145 3 purposes of this definition, requests made by news media and
146146 4 non-profit, scientific, or academic organizations shall not be
147147 5 considered in calculating the number of requests made in the
148148 6 time periods in this definition when the principal purpose of
149149 7 the requests is (i) to access and disseminate information
150150 8 concerning news and current or passing events, (ii) for
151151 9 articles of opinion or features of interest to the public, or
152152 10 (iii) for the purpose of academic, scientific, or public
153153 11 research or education.
154154 12 For the purposes of this subsection (g), "request" means a
155155 13 written document (or oral request, if the public body chooses
156156 14 to honor oral requests) that is submitted to a public body via
157157 15 personal delivery, mail, telefax, electronic mail, or other
158158 16 means available to the public body and that identifies the
159159 17 particular public record the requester seeks. One request may
160160 18 identify multiple records to be inspected or copied.
161161 19 (h) "Voluminous request" means a request that: (i)
162162 20 includes more than 5 individual requests for more than 5
163163 21 different categories of records or a combination of individual
164164 22 requests that total requests for more than 5 different
165165 23 categories of records in a period of 20 business days; or (ii)
166166 24 requires the compilation of more than 500 letter or
167167 25 legal-sized pages of public records unless a single requested
168168 26 record exceeds 500 pages. "Single requested record" may

190190 12 to honor oral requests, that is submitted to a public body via
191191 13 personal delivery, mail, telefax, electronic mail, or other
192192 14 means available to the public body and that identifies the
193193 15 particular public record or records the requester seeks. One
194194 16 request may identify multiple individual records to be
195195 17 inspected or copied.
196196 18 (i) "Severance agreement" means a mutual agreement between
197197 19 any public body and its employee for the employee's
198198 20 resignation in exchange for payment by the public body.
199199 21 (j) "Document", when used in reference to a public body,
200200 22 includes, but is not limited to, documents maintained by the
201201 23 clerk of the circuit court and otherwise available to the
202202 24 public.

215215 1 Section 10. The Judicial Privacy Act is amended by

218218 4 Sec. 1-10. Definitions. As used in this Act:
219219 5 "Government agency" includes all agencies, authorities,
220220 6 boards, commissions, departments, institutions, offices, and
221221 7 any other bodies politic and corporate of the State created by
222222 8 the constitution or statute, whether in the executive,
223223 9 judicial, or legislative branch; all units and corporate
224224 10 outgrowths created by executive order of the Governor or any
225225 11 constitutional officer, by the Supreme Court, or by resolution
226226 12 of the General Assembly; or agencies, authorities, boards,
227227 13 commissions, departments, institutions, offices, and any other
228228 14 bodies politic and corporate of a unit of local government, or
229229 15 school district.
230230 16 "Home address" includes a judicial officer's permanent
231231 17 residence and any secondary residences affirmatively
232232 18 identified by the judicial officer, but does not include a
233233 19 judicial officer's work address.
234234 20 "Immediate family" includes a judicial officer's spouse,
235235 21 child, parent, or any blood relative of the judicial officer
236236 22 or the judicial officer's spouse who lives in the same
237237 23 residence.
238238 24 "Judicial officer" includes actively employed and former

255255 7 (4) Judges of the United States Bankruptcy Court;
256256 8 (5) Judges of the Illinois Appellate Court; and
257257 9 (6) Judges and associate judges of the Illinois
258258 10 Circuit Courts; and
259259 11 (7) State's Attorneys as designated under Article VI,
260260 12 Section 19 of the Illinois Constitution..
261261 13 "Personal information" means a home address, home
262262 14 telephone number, mobile telephone number, pager number,
263263 15 personal email address, social security number, federal tax
264264 16 identification number, checking and savings account numbers,
265265 17 credit card numbers, marital status, and identity of children
266266 18 under the age of 18.
267267 19 "Publicly available content" means any written, printed,
268268 20 or electronic document or record that provides information or
269269 21 that serves as a document or record maintained, controlled, or
270270 22 in the possession of a government agency that may be obtained
271271 23 by any person or entity, from the Internet, from the
272272 24 government agency upon request either free of charge or for a
273273 25 fee, or in response to a request under the Freedom of

285285 1 "Publicly post" or "publicly display" means to communicate
