1212 1 AN ACT concerning transportation.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois Highway Code is amended by
1616 5 changing Sections 6-901 and 6-906 as follows:
1717 6 (605 ILCS 5/6-901) (from Ch. 121, par. 6-901)
1818 7 Sec. 6-901. Annually, the General Assembly shall
1919 8 appropriate to the Department of Transportation from the road
2020 9 fund, the general revenue fund, any other State funds or a
2121 10 combination of those funds, $60,000,000 $15,000,000 for
2222 11 apportionment to counties for the use of road districts for
2323 12 the construction of bridges 20 feet or more in length, as
2424 13 provided in Sections 6-902 through 6-905.
2525 14 The Department of Transportation shall apportion among the
2626 15 several counties of this State for the use of road districts
2727 16 the amounts appropriated under this Section. The amount
2828 17 apportioned to a county shall be in the proportion which the
2929 18 total mileage of township or district roads in the county
3030 19 bears to the total mileage of all township and district roads
3131 20 in the State. Each county shall allocate to the several road
3232 21 districts in the county the funds so apportioned to the
3333 22 county. The allocation to road districts shall be made in the
3434 23 same manner and be subject to the same conditions and

7171 1 qualifications as are provided by Section 8 of the "Motor Fuel
7272 2 Tax Law", approved March 25, 1929, as amended, with respect to
7373 3 the allocation to road districts of the amount allotted from
7474 4 the Motor Fuel Tax Fund for apportionment to counties for the
7575 5 use of road districts, but no allocation shall be made to any
7676 6 road district that has not levied taxes for road and bridge
7777 7 purposes and for bridge construction purposes at the maximum
7878 8 rates permitted by Sections 6-501, 6-508 and 6-512 of this
7979 9 Act, without referendum. "Road district" and "township or
8080 10 district road" have the meanings ascribed to those terms in
8181 11 this Act.
8282 12 Road districts in counties in which a property tax
8383 13 extension limitation is imposed under the Property Tax
8484 14 Extension Limitation Law that are made ineligible for receipt
8585 15 of this appropriation due to the imposition of a property tax
8686 16 extension limitation may become eligible if, at the time the
8787 17 property tax extension limitation was imposed, the road
8888 18 district was levying at the required rate and continues to
8989 19 levy the maximum allowable amount after the imposition of the
9090 20 property tax extension limitation. The road district also
9191 21 becomes eligible if it levies at or above the rate required for
9292 22 eligibility by Section 8 of the Motor Fuel Tax Law.
9393 23 The amounts apportioned under this Section for allocation
9494 24 to road districts may be used only for bridge construction as
9595 25 provided in this Division. So much of those amounts as are not
9696 26 obligated under Sections 6-902 through 6-904 and for which

107107 1 local funds have not been committed under Section 6-905 within
108108 2 48 months of the date when such apportionment is made lapses
109109 3 and shall not be paid to the county treasurer for distribution
110110 4 to road districts.

113113 7 Sec. 6-906. So much of the amount apportioned to a county
114114 8 under Section 6-901 that is obligated under Sections 6-902
115115 9 through 6-904 and for which local funds have been committed
116116 10 under Section 6-905, within 4 years from the date the
117117 11 apportionment is made, shall, upon certification by the
118118 12 Department, be paid to the county treasurer, who shall apply
119119 13 those funds to the payment of such obligations. Any funds
120120 14 allocated to a county under Section 6-901 that are not
121121 15 obligated within 72 48 months under Sections 6-902 through
122122 16 6-904 shall revert to the Road Fund.
