12	12	1 AN ACT concerning transportation.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Illinois Highway Code is amended by
16	16	5 changing Sections 6-901 and 6-906 as follows:

18	18	7 Sec. 6-901. Annually, the General Assembly shall
19	19	8 appropriate to the Department of Transportation from the road
20	20	9 fund, the general revenue fund, any other State funds or a
21	21	10 combination of those funds, $60,000,000 $15,000,000 for
22	22	11 apportionment to counties for the use of road districts for
23	23	12 the construction of bridges 20 feet or more in length, as
24	24	13 provided in Sections 6-902 through 6-905.
25	25	14 The Department of Transportation shall apportion among the
26	26	15 several counties of this State for the use of road districts
27	27	16 the amounts appropriated under this Section. The amount
28	28	17 apportioned to a county shall be in the proportion which the
29	29	18 total mileage of township or district roads in the county
30	30	19 bears to the total mileage of all township and district roads
31	31	20 in the State. Each county shall allocate to the several road
32	32	21 districts in the county the funds so apportioned to the
33	33	22 county. The allocation to road districts shall be made in the
34	34	23 same manner and be subject to the same conditions and

71	71	1 qualifications as are provided by Section 8 of the "Motor Fuel
72	72	2 Tax Law", approved March 25, 1929, as amended, with respect to
73	73	3 the allocation to road districts of the amount allotted from
74	74	4 the Motor Fuel Tax Fund for apportionment to counties for the
75	75	5 use of road districts, but no allocation shall be made to any
76	76	6 road district that has not levied taxes for road and bridge
77	77	7 purposes and for bridge construction purposes at the maximum
78	78	8 rates permitted by Sections 6-501, 6-508 and 6-512 of this
79	79	9 Act, without referendum. "Road district" and "township or
80	80	10 district road" have the meanings ascribed to those terms in
81	81	11 this Act.
82	82	12 Road districts in counties in which a property tax
83	83	13 extension limitation is imposed under the Property Tax
84	84	14 Extension Limitation Law that are made ineligible for receipt
85	85	15 of this appropriation due to the imposition of a property tax
86	86	16 extension limitation may become eligible if, at the time the
87	87	17 property tax extension limitation was imposed, the road
88	88	18 district was levying at the required rate and continues to
89	89	19 levy the maximum allowable amount after the imposition of the
90	90	20 property tax extension limitation. The road district also
91	91	21 becomes eligible if it levies at or above the rate required for
92	92	22 eligibility by Section 8 of the Motor Fuel Tax Law.
93	93	23 The amounts apportioned under this Section for allocation
94	94	24 to road districts may be used only for bridge construction as
95	95	25 provided in this Division. So much of those amounts as are not
96	96	26 obligated under Sections 6-902 through 6-904 and for which

107	107	1 local funds have not been committed under Section 6-905 within
108	108	2 48 months of the date when such apportionment is made lapses
109	109	3 and shall not be paid to the county treasurer for distribution
110	110	4 to road districts.

113	113	7 Sec. 6-906. So much of the amount apportioned to a county
114	114	8 under Section 6-901 that is obligated under Sections 6-902
115	115	9 through 6-904 and for which local funds have been committed
116	116	10 under Section 6-905, within 4 years from the date the
117	117	11 apportionment is made, shall, upon certification by the
118	118	12 Department, be paid to the county treasurer, who shall apply
119	119	13 those funds to the payment of such obligations. Any funds
120	120	14 allocated to a county under Section 6-901 that are not
121	121	15 obligated within 72 48 months under Sections 6-902 through
122	122	16 6-904 shall revert to the Road Fund.
