1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The School Code is amended by adding Section
5 2-3.196 as follows:
6 (105 ILCS 5/2-3.196 new)
7 Sec. 2-3.196. New Arrival Student Grant Program.
8 (a) As used in this Section, "new arrival student" means a
9 student who (i) is an undocumented immigrant, (ii) has entered
10 the United States in refugee status, or (iii) has applied for
11 asylum in the United States.
12 (b) Subject to specific State appropriation, the State
13 Board of Education shall implement and administer a program to
14 make New Arrival Student Grants available to school districts,
15 municipalities, townships, and not-for-profit organizations to
16 support the needs of new arrival students in a school
17 district.
18 (c) To receive a grant under this program, a school
19 district, municipality, township, or not-for-profit
20 organization shall submit an application to the State Board of
21 Education at such time, in such manner, and containing or
22 accompanied by such information as the State Board of

3 (d) The State Board of Education, subject to appropriation
4 for this program, shall annually disseminate a request for
5 applications to the program, and funds shall be distributed
6 annually. In awarding funds under this program, the State
7 Board of Education may consider (i) the number of new arrival
8 students enrolled in preschool, elementary school, and
9 secondary school within a school district, (ii) the needs of
10 new arrival students in a school district, and (iii) the
11 ability of the school district, municipality, township, or
12 not-for-profit organization to meet the needs of new arrival
13 students.
14 Section 99. Effective date. This Act takes effect July 1,
15 2023.
