311 1 AN ACT concerning State government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 1. Short title. This Act may be cited as the State
715 5 Agency and Grantee Bonus Prohibition Act.
816 6 Section 5. Definitions. As used in this Act:
917 7 "Employee" means any person employed, full-time,
1018 8 part-time, or contractually, in any capacity by a State agency
1119 9 or hospital, without regard to whether that person's
1220 10 employment is subject to the advice and consent of the Senate
1321 11 or is for a stated term. "Employee" does not include persons
1422 12 subject to a collective bargaining agreement.
1523 13 "Grant funds" has the meaning provided in Section 2 of the
1624 14 Illinois Grant Funds Recovery Act.
1725 15 "Grantee" has the meaning provided in Section 2 of the
1826 16 Illinois Grant Funds Recovery Act.
1927 17 "Hospital" has the meaning provided in Section 3 of the
2028 18 Hospital Licensing Act.
2129 19 "State agency" has the meaning provided in Section
2230 20 1-15.100 of the Illinois Procurement Code.
2331 21 Section 10. Bonuses prohibited.
2432 22 (a) No State agency or hospital shall pay from State

33-1 funds, in whole or in part, and no employee of a State agency
34-2 or hospital may receive a bonus as all or part of his or her
35-3 compensation, including such bonuses as may be received for
36-4 work on capital projects.
37-5 (b) No grantee shall pay, and no employee or contract
38-6 worker of a grantee may receive, a bonus paid from grant funds
39-7 awarded for operational expenses as all or part of his or her
40-8 compensation, including such bonuses as may be received for
41-9 work on capital projects.
42-10 (c) State agencies who use bonuses paid to State employees
43-11 shall provide an annual report to the General Assembly
44-12 itemizing each bonus awarded, including the amount of the
45-13 bonuses awarded, the purpose of the bonus, the position of the
46-14 employees to whom bonuses were awarded, and the overall agency
47-15 fiscal impact for the bonuses awarded in the prior fiscal
48-16 year. This report shall be due December 1, 2023 to the General
49-17 Assembly and annually thereafter. Recruitment or retention
50-18 bonuses for State employment shall be no more than $10,000 per
51-19 bonus unless the Department of Central Management Services
52-20 adopts rules increasing the monetary limit per bonus.
53-21 Section 99. Effective date. This Act takes effect upon
54-22 becoming law.
