1  AN ACT concerning State government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 1. Short title. This Act may be cited as the State
5  Agency and Grantee Bonus Prohibition Act.
6  Section 5. Definitions. As used in this Act:
7  "Employee" means any person employed, full-time,
8  part-time, or contractually, in any capacity by a State agency
9  or hospital, without regard to whether that person's
10  employment is subject to the advice and consent of the Senate
11  or is for a stated term. "Employee" does not include persons
12  subject to a collective bargaining agreement.
13  "Grant funds" has the meaning provided in Section 2 of the
14  Illinois Grant Funds Recovery Act.
15  "Grantee" has the meaning provided in Section 2 of the
16  Illinois Grant Funds Recovery Act.
17  "Hospital" has the meaning provided in Section 3 of the
18  Hospital Licensing Act.
19  "State agency" has the meaning provided in Section
20  1-15.100 of the Illinois Procurement Code.
21  Section 10. Bonuses prohibited.
22  (a) No State agency or hospital shall pay from State

1  funds, in whole or in part, and no employee of a State agency
2  or hospital may receive a bonus as all or part of his or her
3  compensation, including such bonuses as may be received for
4  work on capital projects.
5  (b) No grantee shall pay, and no employee or contract
6  worker of a grantee may receive, a bonus paid from grant funds
7  awarded for operational expenses as all or part of his or her
8  compensation, including such bonuses as may be received for
9  work on capital projects.
10  (c) State agencies who use bonuses paid to State employees
11  shall provide an annual report to the General Assembly
12  itemizing each bonus awarded, including the amount of the
13  bonuses awarded, the purpose of the bonus, the position of the
14  employees to whom bonuses were awarded, and the overall agency
15  fiscal impact for the bonuses awarded in the prior fiscal
16  year. This report shall be due December 1, 2023 to the General
17  Assembly and annually thereafter. Recruitment or retention
18  bonuses for State employment shall be no more than $10,000 per
19  bonus unless the Department of Central Management Services
20  adopts rules increasing the monetary limit per bonus.
21  Section 99. Effective date. This Act takes effect upon
22  becoming law.
