1313 Amends various Acts relating to the governance of public universities and community colleges in Illinois. 1919 1 AN ACT concerning education.
2020 2 Be it enacted by the People of the State of Illinois,
2121 3 represented in the General Assembly:
2222 4 Section 5. The University of Illinois Act is amended by
2323 5 changing Section 7e-5 as follows:

2525 7 Sec. 7e-5. In-state tuition charge.
2626 8 (a) Notwithstanding any other provision of law to the
2727 9 contrary, at a minimum, for tuition purposes, the Board of
2828 10 Trustees shall deem an individual an Illinois resident, until
2929 11 the individual establishes a residence outside of this State,
3030 12 if all of the following conditions are met:
3131 13 (1) The individual enrolls in or attains credits at
3232 14 any of the following: The individual resided with his or
3333 15 her parent or guardian while attending a public or private
3434 16 high school in this State.
3535 17 (A) a public or private elementary school in this
3636 18 State;
3737 19 (B) a public or private high school in this State;
3838 20 (C) an adult school organized under the Public

109109 18 student in the University not earlier than the 2003 fall
110110 19 semester.
111111 20 (5) In the case of an individual who is not a citizen
112112 21 or a permanent resident of the United States, the
113113 22 individual provides the University with an affidavit
114114 23 stating that the individual will file an application to
115115 24 become a permanent resident of the United States at the
116116 25 earliest opportunity the individual is eligible to do so.

129129 2 date of Public Act 93-7). Any revenue lost by the University in
130130 3 implementing this subsection (a) shall be absorbed by the

132132 5 (b) If a person is on active military duty and stationed in
133133 6 Illinois, then the Board of Trustees shall deem that person
134134 7 and any of his or her dependents Illinois residents for
135135 8 tuition purposes. Beginning with the 2009-2010 academic year,
136136 9 if a person is on active military duty and is stationed out of
137137 10 State, but he or she was stationed in this State for at least 3
138138 11 years immediately prior to being reassigned out of State, then
139139 12 the Board of Trustees shall deem that person and any of his or
140140 13 her dependents Illinois residents for tuition purposes, as
141141 14 long as that person or his or her dependent (i) applies for
142142 15 admission to the University within 18 months of the person on
143143 16 active military duty being reassigned or (ii) remains
144144 17 continuously enrolled at the University. Beginning with the
145145 18 2013-2014 academic year, if a person is utilizing benefits
146146 19 under the federal Post-9/11 Veterans Educational Assistance
147147 20 Act of 2008 or any subsequent variation of that Act, then the
148148 21 Board of Trustees shall deem that person an Illinois resident
149149 22 for tuition purposes. Beginning with the 2015-2016 academic
150150 23 year, if a person is utilizing benefits under the federal
151151 24 All-Volunteer Force Educational Assistance Program, then the
152152 25 Board of Trustees shall deem that person an Illinois resident

948948 8 establishes a residence outside of this State, if all of the
949949 9 following conditions are met:
950950 10 (1) The individual enrolls in or attains credits at
951951 11 any of the following: The individual resided with his or
952952 12 her parent or guardian while attending a public or private
953953 13 high school in this State.
954954 14 (A) a public or private elementary school in this
955955 15 State;
956956 16 (B) a public or private high school in this State;
957957 17 (C) an adult school organized under the Public
958958 18 Community College Act; or
959959 19 (D) a community college campus organized under the
960960 20 Public Community College Act.
961961 21 (2) The individual satisfies any of the following:
962962 22 (A) the The individual graduated from a public or
963963 23 private high school or received the equivalent of a
964964 24 high school diploma in this State; .
965965 25 (B) the individual attained an associate degree

976976 1 from a community college campus organized under the
977977 2 Public Community College Act; or
978978 3 (C) the individual fulfilled the minimum transfer
979979 4 requirements established by Western Illinois
980980 5 University for students transferring from a campus of
981981 6 a community college organized under the Public
982982 7 Community College Act.
983983 8 (3) (Blank.) The individual attended school in this
984984 9 State for at least 3 years as of the date the individual
985985 10 graduated from high school or received the equivalent of a
986986 11 high school diploma.
987987 12 (4) (Blank.) The individual registers as an entering
988988 13 student in the University not earlier than the 2003 fall
989989 14 semester.
990990 15 (5) In the case of an individual who is not a citizen
991991 16 or a permanent resident of the United States, the
992992 17 individual provides the University with an affidavit
993993 18 stating that the individual will file an application to
994994 19 become a permanent resident of the United States at the
995995 20 earliest opportunity the individual is eligible to do so.
996996 21 This subsection (a) applies only to tuition for a term or
997997 22 semester that begins on or after May 20, 2003 (the effective
998998 23 date of Public Act 93-7). Any revenue lost by the University in
999999 24 implementing this subsection (a) shall be absorbed by the

10121012 1 Illinois, then the Board shall deem that person and any of his
10131013 2 or her dependents Illinois residents for tuition purposes.
10141014 3 Beginning with the 2009-2010 academic year, if a person is on
10151015 4 active military duty and is stationed out of State, but he or
10161016 5 she was stationed in this State for at least 3 years
10171017 6 immediately prior to being reassigned out of State, then the
10181018 7 Board shall deem that person and any of his or her dependents
10191019 8 Illinois residents for tuition purposes, as long as that
10201020 9 person or his or her dependent (i) applies for admission to the
10211021 10 University within 18 months of the person on active military
10221022 11 duty being reassigned or (ii) remains continuously enrolled at
10231023 12 the University. Beginning with the 2013-2014 academic year, if
10241024 13 a person is utilizing benefits under the federal Post-9/11
10251025 14 Veterans Educational Assistance Act of 2008 or any subsequent
10261026 15 variation of that Act, then the Board shall deem that person an
10271027 16 Illinois resident for tuition purposes. Beginning with the
10281028 17 2015-2016 academic year, if a person is utilizing benefits
10291029 18 under the federal All-Volunteer Force Educational Assistance
10301030 19 Program, then the Board shall deem that person an Illinois
10311031 20 resident for tuition purposes. Beginning with the 2019-2020
10321032 21 academic year, per the federal requirements for maintaining
10331033 22 approval for veterans' education benefits under 38 U.S.C.
10341034 23 3679(c), if a person is on active military duty or is receiving
10351035 24 veterans' education benefits, then the Board of Trustees shall
10361036 25 deem that person an Illinois resident for tuition purposes for
10371037 26 any academic quarter, semester, or term, as applicable.
