4-AN ACT concerning regulation.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 1. References to Act; purpose.
8-(a) References to Act. This Act may be referred to as the
9-Mental Health and Wellness Act.
10-(b) Purpose. This Act is intended to address Illinois'
11-skyrocketing mental health needs for children, youth, and
12-adults following the COVID-19 pandemic by covering preventive
13-mental health care.
14-Section 5. Findings. The General Assembly finds that:
15-(1) According to a recent U.S. Surgeon General's
16-Advisory on Protecting Youth Mental Health, the proportion
17-of high school students reporting persistent feelings of
18-hopelessness and sadness increased by 40% between 2009 and
19-2019, and rates of depression and anxiety doubled during
20-the COVID-19 pandemic.
21-(2) Death by suicide is alarmingly high, particularly
22-among Black children. Black children under 13 are now
23-nearly twice as likely to die by suicide than White
24-children.
25-(3) According to a bipartisan United States Senate
26-Finance Committee report on Mental Health Care in the

115-Section 15. The Department of Public Health Powers and
116-Duties Law of the Civil Administrative Code of Illinois is
117-amended by adding Section 2310-720 as follows:

119-Sec. 2310-720. Public educational effort on mental health
120-and wellness. Subject to appropriation, the Department shall
121-undertake a public educational campaign to bring broad public
122-awareness to communities across this State on the importance
123-of mental health and wellness, including the expanded coverage
124-of mental health treatment, and consistent with the
125-recommendations of the Illinois Children's Mental Health
126-Partnership's Children's Mental Health Plan of 2022 and Public
127-Act 102-899. The Department shall look to other successful
128-public educational campaigns to guide this effort, such as the
129-public educational campaign related to Get Covered Illinois.
130-Additionally, the Department shall work with the Department of
131-Insurance, the Illinois State Board of Education, the
132-Department of Human Services, the Department of Healthcare and
133-Family Services, the Department of Juvenile Justice, the
134-Department of Children and Family Services, and other State
135-agencies as necessary to promote consistency in messaging and
136-distribution methods between this campaign and other
137-concurrent public educational campaigns related to mental

266-(a) A group or individual policy of accident and health
267-insurance or managed care plan that is amended, delivered,
268-issued, or renewed on or after January 1, 2025 shall provide
269-coverage for one annual mental health prevention and wellness

272-visit for children and for adults.
273-(b) Mental health prevention and wellness visits shall
274-include any age-appropriate screening recommended by the
275-United States Preventive Services Task Force or by the
276-American Academy of Pediatrics' Bright Futures: Guidelines for
277-Health Supervision of Infants, Children, and Adolescents for
278-purposes of identifying a mental health issue, condition, or
279-disorder; discussing mental health symptoms that might be
280-present, including symptoms of a previously diagnosed mental
281-health condition or disorder; performing an evaluation of
282-adverse childhood experiences; and discussing mental health
283-and wellness.
284-(c) A mental health prevention and wellness visit shall be
285-covered for up to 60 minutes and may be performed by a
286-physician licensed to practice medicine in all of its
287-branches, a licensed clinical psychologist, a licensed
288-clinical social worker, a licensed clinical professional
289-counselor, a licensed marriage and family therapist, a

351+7 purposes of identifying a mental health issue, condition, or
352+8 disorder; discussing mental health symptoms that might be
353+9 present, including symptoms of a previously diagnosed mental
354+10 health condition or disorder; performing an evaluation of
355+11 adverse childhood experiences; and discussing mental health
356+12 and wellness.
357+13 (c) A mental health prevention and wellness visit shall be
358+14 covered for up to 60 minutes and may be performed by a
359+15 physician licensed to practice medicine in all of its
360+16 branches, a licensed clinical psychologist, a licensed
361+17 clinical social worker, a licensed clinical professional
362+18 counselor, a licensed marriage and family therapist, a
363+19 licensed social worker, or a licensed professional counselor.
