1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The State Finance Act is amended by changing
1515 5 Section 12-2 as follows:

1717 7 Sec. 12-2. Travel Regulation Council; State travel
1818 8 reimbursement.
1919 9 (a) The chairmen of the travel control boards established
2020 10 by Section 12-1, or their designees, shall together comprise
2121 11 the Travel Regulation Council. The Travel Regulation Council
2222 12 shall be chaired by the Director of Central Management
2323 13 Services, who shall be a nonvoting member of the Council,
2424 14 unless he is otherwise qualified to vote by virtue of being the
2525 15 designee of a voting member. No later than March 1, 1986, and
2626 16 at least biennially thereafter, the Council shall adopt State
2727 17 Travel Regulations and Reimbursement Rates which shall be
2828 18 applicable to all personnel subject to the jurisdiction of the
2929 19 travel control boards established by Section 12-1. An
3030 20 affirmative vote of a majority of the members of the Council
3131 21 shall be required to adopt regulations and reimbursement
3232 22 rates. If the Council fails to adopt regulations by March 1 of
3333 23 any odd-numbered year, the Director of Central Management

6868 1 Services shall adopt emergency regulations and reimbursement
6969 2 rates pursuant to the Illinois Administrative Procedure Act.
7070 3 On and after the effective date of this amendatory Act of the
7171 4 103rd General Assembly, the Council shall adopt reimbursement
7272 5 rates in accordance with the requirements of subsection (f).
7373 6 (b) (Blank). Mileage for automobile travel shall be
7474 7 reimbursed at the allowance rate in effect under regulations
7575 8 promulgated pursuant to 5 U.S.C. 5707(b)(2). In the event the
7676 9 rate set under federal regulations increases or decreases
7777 10 during the course of the State's fiscal year, the effective
7878 11 date of the new rate shall be the effective date of the change
7979 12 in the federal rate.
8080 13 (c) (Blank). Rates for reimbursement of expenses other
8181 14 than mileage shall not exceed the actual cost of travel as
8282 15 determined by the United States Internal Revenue Service.
8383 16 (d) Reimbursements to travelers shall be made pursuant to
8484 17 the rates and regulations applicable to the respective State
8585 18 agency as of the effective date of this amendatory Act, until
8686 19 the State Travel Regulations and Reimbursement Rates
8787 20 established by this Section are adopted and effective.
8888 21 (e) (Blank). Lodging in Cook County, Illinois and the
8989 22 District of Columbia shall be reimbursed at the maximum
9090 23 lodging rate in effect under regulations promulgated pursuant
9191 24 to 5 U.S.C. 5701-5709. For purposes of this subsection (e),
9292 25 the District of Columbia shall include the cities and counties
9393 26 included in the per diem locality of the District of Columbia,

104104 1 as defined by the regulations in effect promulgated pursuant
105105 2 to 5 U.S.C. 5701-5709. Individual travel control boards may
106106 3 set a lodging reimbursement rate more restrictive than the
107107 4 rate set forth in the federal regulations.
108108 5 (f) Notwithstanding any rule or law to the contrary, State
109109 6 travel reimbursement rates for lodging and mileage for
110110 7 automobile travel, as well as allowances for meals, shall be
111111 8 set at the maximum rates established by the federal government
112112 9 for travel expenses, subsistence expenses, and mileage
113113 10 allowances under 5 U.S.C. 5701-5711 and any regulations
114114 11 promulgated thereunder. If the rates set under federal
115115 12 regulations increase or decrease during the course of the
116116 13 State's fiscal year, the effective date of the new rate shall
117117 14 be the effective date of the change in the federal rate.
