13	13	1 AN ACT concerning State government.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 5. The State Treasurer Act is amended by changing
17	17	5 Section 18 as follows:

19	19	7 Sec. 18. Banking and automated automatic teller machine
20	20	8 services.
21	21	9 (a) The Treasurer may enter into written agreements with
22	22	10 financial institutions for the provision of banking services
23	23	11 at the State Capitol and with automated teller machine
24	24	12 providers for the provision of automated automatic teller
25	25	13 machine services at State office buildings, State parks, State
26	26	14 tourism centers, and State fairs at Springfield and DuQuoin.
27	27	15 The Treasurer shall establish competitive procedures for the
28	28	16 selection of financial institutions and automated teller
29	29	17 machine providers to provide the services authorized under
30	30	18 this Section. No State agency may procure services authorized
31	31	19 by this Section without the approval of the Treasurer.
32	32	20 (b) The Treasurer shall enter into written agreements with
33	33	21 the authorities having jurisdiction of the property where the
34	34	22 services are intended to be provided. These agreements shall
35	35	23 include, but need not be limited to, the quantity of machines

74	74	1 to be located at the property and the exact location of the
75	75	2 service or machine and shall establish responsibility for
76	76	3 payment of expenses incurred in locating the machine or
77	77	4 service.
78	78	5 (c) The Treasurer's agreement with a financial institution
79	79	6 or automated teller machine providers may authorize the
80	80	7 financial institution or automated teller machine providers to
81	81	8 provide any or all of the banking services that the financial
82	82	9 institution or automated teller machine providers is otherwise
83	83	10 authorized by law to provide to the public.
84	84	11 The Treasurer's agreement with a financial institution or
85	85	12 automated teller machine providers shall establish the amount
86	86	13 of compensation to be paid by the financial institution. The
87	87	14 financial institution or automated teller machine providers
88	88	15 shall pay the compensation to the Treasurer in accordance with
89	89	16 the terms of the agreement. The Treasurer shall deposit moneys
90	90	17 received under this Section into the State Treasurers Bank
91	91	18 Services Trust Fund. Treasurer's Rental Fee Fund, a special
92	92	19 fund hereby created in the State treasury. The Treasurer shall
93	93	20 use the moneys in the Fund for the operation of the program
94	94	21 established under this Section. If the Treasurer determines
95	95	22 that any moneys in the Treasurer's Rental Fee Fund are in
96	96	23 excess of the amount necessary to sustain the operation of the
97	97	24 program established under this Section, the Treasurer may
98	98	25 transfer any unobligated and unexpended moneys from the
99	99	26 Treasurer's Rental Fee Fund into the State Pensions Fund.

110	110	1 (d) This Section does not apply to a State office building
111	111	2 in which a currency exchange or a credit union providing
112	112	3 financial services located in the building on July 1, 1995
113	113	4 (the effective date of Public Act 88-640) is operating.
114	114	5 (e) Notwithstanding any other provision of law to the
115	115	6 contrary, and in addition to any other transfers that may be
116	116	7 provided by law, within 30 days of the effective date of this
117	117	8 amendatory Act of the 103rd General Assembly, or as soon
118	118	9 thereafter as practicable, the State Comptroller shall direct
119	119	10 and the State Treasurer shall transfer the remaining balance
120	120	11 from the Treasurer's Rental Fee Fund into the State
121	121	12 Treasurers Bank Services Trust Fund. Upon completion of the
122	122	13 transfer, the Treasurer's Rental Fee Fund is dissolved, and
123	123	14 any future deposits due to that Fund and any outstanding
124	124	15 obligations or liabilities of that Fund shall pass to the
125	125	16 State Treasurers Bank Services Trust Fund.

148	148	5 Act is amended by changing Section 10 as follows:

150	150	7 Sec. 10. Creation of Fund. There is hereby created in the
151	151	8 State treasury a special fund to be known as the State
152	152	9 Treasurer's Bank Services Trust Fund. Moneys deposited in the
153	153	10 Fund shall be used by the State Treasurer to pay the cost of
154	154	11 the following banking services: processing of payments of
155	155	12 taxes, fees, and other moneys due the State; transactional,
156	156	13 technological, consultant, legal service charges, and other
157	157	14 operational expenses of the State Treasurer's Office related
158	158	15 to the investment or safekeeping of funds under the
159	159	16 Treasurer's control; the provision of banking and automated
160	160	17 teller machine services at State office buildings, State
161	161	18 parks, State tourism centers, and State fairs at Springfield
162	162	19 and DuQuoin; and the cost of paying bondholders and legal
163	163	20 services under the State's general obligation bond program.
