1313 1 AN ACT concerning State government.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The State Treasurer Act is amended by changing
1717 5 Section 18 as follows:

1919 7 Sec. 18. Banking and automated automatic teller machine
2020 8 services.
2121 9 (a) The Treasurer may enter into written agreements with
2222 10 financial institutions for the provision of banking services
2323 11 at the State Capitol and with automated teller machine
2424 12 providers for the provision of automated automatic teller
2525 13 machine services at State office buildings, State parks, State
2626 14 tourism centers, and State fairs at Springfield and DuQuoin.
2727 15 The Treasurer shall establish competitive procedures for the
2828 16 selection of financial institutions and automated teller
2929 17 machine providers to provide the services authorized under
3030 18 this Section. No State agency may procure services authorized
3131 19 by this Section without the approval of the Treasurer.
3232 20 (b) The Treasurer shall enter into written agreements with
3333 21 the authorities having jurisdiction of the property where the
3434 22 services are intended to be provided. These agreements shall
3535 23 include, but need not be limited to, the quantity of machines

7474 1 to be located at the property and the exact location of the
7575 2 service or machine and shall establish responsibility for
7676 3 payment of expenses incurred in locating the machine or
7777 4 service.
7878 5 (c) The Treasurer's agreement with a financial institution
7979 6 or automated teller machine providers may authorize the
8080 7 financial institution or automated teller machine providers to
8181 8 provide any or all of the banking services that the financial
8282 9 institution or automated teller machine providers is otherwise
8383 10 authorized by law to provide to the public.
8484 11 The Treasurer's agreement with a financial institution or
8585 12 automated teller machine providers shall establish the amount
8686 13 of compensation to be paid by the financial institution. The
8787 14 financial institution or automated teller machine providers
8888 15 shall pay the compensation to the Treasurer in accordance with
8989 16 the terms of the agreement. The Treasurer shall deposit moneys
9090 17 received under this Section into the State Treasurers Bank
9191 18 Services Trust Fund. Treasurer's Rental Fee Fund, a special
9292 19 fund hereby created in the State treasury. The Treasurer shall
9393 20 use the moneys in the Fund for the operation of the program
9494 21 established under this Section. If the Treasurer determines
9595 22 that any moneys in the Treasurer's Rental Fee Fund are in
9696 23 excess of the amount necessary to sustain the operation of the
9797 24 program established under this Section, the Treasurer may
9898 25 transfer any unobligated and unexpended moneys from the
9999 26 Treasurer's Rental Fee Fund into the State Pensions Fund.

110110 1 (d) This Section does not apply to a State office building
111111 2 in which a currency exchange or a credit union providing
112112 3 financial services located in the building on July 1, 1995
113113 4 (the effective date of Public Act 88-640) is operating.
114114 5 (e) Notwithstanding any other provision of law to the
115115 6 contrary, and in addition to any other transfers that may be
116116 7 provided by law, within 30 days of the effective date of this
117117 8 amendatory Act of the 103rd General Assembly, or as soon
118118 9 thereafter as practicable, the State Comptroller shall direct
119119 10 and the State Treasurer shall transfer the remaining balance
120120 11 from the Treasurer's Rental Fee Fund into the State
121121 12 Treasurers Bank Services Trust Fund. Upon completion of the
122122 13 transfer, the Treasurer's Rental Fee Fund is dissolved, and
123123 14 any future deposits due to that Fund and any outstanding
124124 15 obligations or liabilities of that Fund shall pass to the
125125 16 State Treasurers Bank Services Trust Fund.

150150 7 Sec. 10. Creation of Fund. There is hereby created in the
151151 8 State treasury a special fund to be known as the State
152152 9 Treasurer's Bank Services Trust Fund. Moneys deposited in the
153153 10 Fund shall be used by the State Treasurer to pay the cost of
154154 11 the following banking services: processing of payments of
155155 12 taxes, fees, and other moneys due the State; transactional,
156156 13 technological, consultant, legal service charges, and other
157157 14 operational expenses of the State Treasurer's Office related
158158 15 to the investment or safekeeping of funds under the
159159 16 Treasurer's control; the provision of banking and automated
160160 17 teller machine services at State office buildings, State
161161 18 parks, State tourism centers, and State fairs at Springfield
162162 19 and DuQuoin; and the cost of paying bondholders and legal
163163 20 services under the State's general obligation bond program.
