The State Treasurer Act is amended by changing 5 Section 18 as follows: 6 (15 ILCS 505/18) 7 Sec. 18. Banking and automated automatic teller machine 8 services. 9 (a) The Treasurer may enter into written agreements with 10 financial institutions for the provision of banking services 11 at the State Capitol and with automated teller machine 12 providers for the provision of automated automatic teller 13 machine services at State office buildings, State parks, State 14 tourism centers, and State fairs at Springfield and DuQuoin. 15 The Treasurer shall establish competitive procedures for the 16 selection of financial institutions and automated teller 17 machine providers to provide the services authorized under 18 this Section. No State agency may procure services authorized 19 by this Section without the approval of the Treasurer. 20 (b) The Treasurer shall enter into written agreements with 21 the authorities having jurisdiction of the property where the 22 services are intended to be provided. The 14 financial institution or automated teller machine providers 15 shall pay the compensation to the Treasurer in accordance with 16 the terms of the agreement. The Treasurer shall deposit moneys 17 received under this Section into the State Treasurers Bank 18 Services Trust Fund. Treasurer's Rental Fee Fund, a special 19 fund hereby created in the State treasury. The Treasurer shall 20 use the moneys in the Fund for the operation of the program 21 established under this Section. If the Treasurer determines 22 that any moneys in the Treasurer's Rental Fee Fund are in 23 excess of the amount necessary to sustain the operation of the 24 program established under this Section, the Treasurer may 25 transfer any unobligated and unexpended moneys from the 26 Treasurer's Rental Fee Fund into the State Pensions Fund. HB2960 - 2 - LRB103 25427 DTM 51775 b HB2960- 3 -LRB103 25427 DTM 51775 b HB2960 - 3 - LRB103 25427 DTM 51775 b HB2960 - 3 - LRB103 25427 DTM 51775 b 1 (d) This Section does not apply to a State office building 2 in which a currency exchange or a credit union providing 3 financial services located in the building on July 1, 1995 4 (the effective date of Public Act 88-640) is operating. 5 (e) Notwithstanding any other provision of law to the 6 contrary, and in addition to any other transfers that may be 7 provided by law, within 30 days of the effective date of this 8 amendatory Act of the 103rd General Assembly, or as soon 9 thereafter as practicable, the State Comptroller shall direct 10 and the State Treasurer shall transfer the remaining balance 11 from the Treasurer's Rental Fee Fund into the State 12 Treasurers Bank Services Trust Fund. Upon completion of the 13 transfer, the Treasurer's Rental Fee Fund is dissolved, and 14 any future deposits due to that Fund and any outstanding 15 obligations or liabilities of that Fund shall pass to the 16 State Treasurers Bank Services Trust Fund. 17 (Source: P.A. 98-19, eff. 6-10-13.) 18 Section 10. The State Finance Act is amended by changing 19 Section 5.397 as follows: 20 (30 ILCS 105/5.397) 21 Sec. 5.397. The Treasurer's Rental Fee Fund. This Fund is 22 dissolved upon the transfer of the remaining balance from the 23 Treasurer's Rental Fee Fund to the State Treasurer's Bank 24 Services Trust Fund as provided under subsection (e) of HB2960 - 3 - LRB103 25427 DTM 51775 b HB2960- 4 -LRB103 25427 DTM 51775 b HB2960 - 4 - LRB103 25427 DTM 51775 b HB2960 - 4 - LRB103 25427 DTM 51775 b 1 Section 18 of the State Treasurer Act. The State Treasurer's Bank Services Trust Fund 5 Act is amended by changing Section 10 as follows: 6 (30 ILCS 212/10) 7 Sec. 10. Creation of Fund. There is hereby created in the 8 State treasury a special fund to be known as the State 9 Treasurer's Bank Services Trust Fund. Moneys deposited in the 10 Fund shall be used by the State Treasurer to pay the cost of 11 the following banking services: processing of payments of 12 taxes, fees, and other moneys due the State; transactional, 13 technological, consultant, legal service charges, and other 14 operational expenses of the State Treasurer's Office related 15 to the investment or safekeeping of funds under the 16 Treasurer's control; the provision of banking and automated 17 teller machine services at State office buildings, State 18 parks, State tourism centers, and State fairs at Springfield 19 and DuQuoin; and the cost of paying bondholders and legal 20 services under the State's general obligation bond program. 21 (Source: P.A. 100-587, eff. 6-4-18.)
