1414 1 AN ACT concerning government.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Substance Use Disorder Act is amended by
1818 5 adding Section 55-41 as follows:
1919 6 (20 ILCS 301/55-41 new)
2020 7 Sec. 55-41. Recovery residences.
2121 8 (a) As used in this Section, "recovery residence" means a
2222 9 sober, safe, and healthy living environment that promotes
2323 10 recovery from alcohol and other drug use and associated
2424 11 problems.
2525 12 (b) No later than one year after the effective date of this
2626 13 amendatory Act of the 103rd General Assembly, the Department
2727 14 shall adopt rules to establish minimum standards and
2828 15 requirements for the licensure of recovery residences in the
2929 16 State necessary to ensure public health, safety, and welfare.
3030 17 The Department may use the current standards adopted by any
3131 18 recognized national organization approved by the Department as
3232 19 guidelines in prescribing the minimum standards and
3333 20 requirements.
3434 21 (c) The Department may impose a civil penalty on a person
3535 22 in violation of the rules and standards established by the
3636 23 Department. The Department may impose sanctions and commence

8787 11 Sec. 11-12-6.5. Recovery residences. Notwithstanding any
8888 12 other provision of law, the corporate authorities of a
8989 13 municipality may, in its ordinances passed under Section
9090 14 11-12-5, classify, regulate, and restrict recovery residences,
9191 15 including on the basis of a recovery residence's compliance
9292 16 with the Department of Human Services' rules for recovery
9393 17 residences.
9494 18 As used in this Section, "recovery residence" has the
9595 19 meaning given to that term in Section 55-41 of the Substance
9696 20 Use Disorder Act.
