14	14	1 AN ACT concerning government.
15	15	2 Be it enacted by the People of the State of Illinois,
16	16	3 represented in the General Assembly:
17	17	4 Section 5. The Substance Use Disorder Act is amended by
18	18	5 adding Section 55-41 as follows:
19	19	6 (20 ILCS 301/55-41 new)
20	20	7 Sec. 55-41. Recovery residences.
21	21	8 (a) As used in this Section, "recovery residence" means a
22	22	9 sober, safe, and healthy living environment that promotes
23	23	10 recovery from alcohol and other drug use and associated
24	24	11 problems.
25	25	12 (b) No later than one year after the effective date of this
26	26	13 amendatory Act of the 103rd General Assembly, the Department
27	27	14 shall adopt rules to establish minimum standards and
28	28	15 requirements for the licensure of recovery residences in the
29	29	16 State necessary to ensure public health, safety, and welfare.
30	30	17 The Department may use the current standards adopted by any
31	31	18 recognized national organization approved by the Department as
32	32	19 guidelines in prescribing the minimum standards and
33	33	20 requirements.
34	34	21 (c) The Department may impose a civil penalty on a person
35	35	22 in violation of the rules and standards established by the
36	36	23 Department. The Department may impose sanctions and commence

87	87	11 Sec. 11-12-6.5. Recovery residences. Notwithstanding any
88	88	12 other provision of law, the corporate authorities of a
89	89	13 municipality may, in its ordinances passed under Section
90	90	14 11-12-5, classify, regulate, and restrict recovery residences,
91	91	15 including on the basis of a recovery residence's compliance
92	92	16 with the Department of Human Services' rules for recovery
93	93	17 residences.
94	94	18 As used in this Section, "recovery residence" has the
95	95	19 meaning given to that term in Section 55-41 of the Substance
96	96	20 Use Disorder Act.
