313 1 AN ACT concerning health.
414 2 Be it enacted by the People of the State of Illinois,
515 3 represented in the General Assembly:
616 4 Section 5. The Equitable Restrooms Act is amended by
717 5 changing Section 20 and by adding Sections 30 and 35 as
818 6 follows:
919 7 (410 ILCS 35/20) (from Ch. 111 1/2, par. 3751-20)
1020 8 Sec. 20. Application. Except for Section 25 and Section
1121 9 30, this Act applies only to places of public accommodation
1222 10 that commence construction, or that commence alterations
1323 11 exceeding 50% of the entire place of public accommodation,
1424 12 after the effective date of this Act.

1727 15 Sec. 30. Menstrual hygiene products in public restrooms.
1828 16 (a) The General Assembly finds that:
1929 17 (1) menstrual hygiene products are a health care
2030 18 necessity and not an item that can be forgone or
2131 19 substituted easily; and
2232 20 (2) access to menstrual hygiene products is a serious
2333 21 and ongoing need in this State.

33-1 "Menstrual hygiene products" means tampons and sanitary
34-2 napkins for use in connection with the menstrual cycle.
35-3 "Public restroom" means any public toilet facility that is
36-4 available without preference to any specific gender or any
37-5 public toilet facility that is available only to women.
38-6 "Public restroom" does not include any public toilet facility
39-7 in a mosque, temple, church, and other places of worship if the
40-8 provision of menstrual hygiene products would conflict with
41-9 the entity's sincerely held religious beliefs, practices, or
42-10 observances.
43-11 (c) This Section applies to any existing or future public
44-12 buildings, as that term is defined in Section 18.
45-13 (d) Notwithstanding any other provision of law, the owner
46-14 of a public restroom shall make available and accessible in
47-15 that public restroom menstrual hygiene products at no cost and
48-16 shall be responsible for ordering, stocking, and replenishing
49-17 the supply of those products in that restroom.
50-18 (e) During any inspection of a public building by a health
51-19 officer or health inspector, the health officer or health
52-20 inspector may inspect the public building to determine whether
53-21 it complies with this Section.
54-22 (f) The Department of Public Health shall adopt rules to
55-23 implement this Section.

89+17 public restroom. This subsection does not apply to mosques,
90+18 temples, churches, and other places of worship if compliance
91+19 with the provision would conflict with the entity's sincerely
92+20 held religious beliefs, practices, or observances.
93+21 (e) During any inspection of a public building by a health
94+22 officer or health inspector, the health officer or health
95+23 inspector may inspect the public building to determine whether

110+2 Sec. 35. Violation. A place of public accommodation or a
111+3 public building that violates Section 18, Section 25, or
112+4 Section 30 is guilty of a petty offense. The penalty is a fine
113+5 of not more than $100.
114+6 Section 99. Effective date. This Act takes effect upon
115+7 becoming law.
