1414 1 AN ACT concerning public employee benefits.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The Illinois Pension Code is amended by
1818 5 changing Section 7-109.3 as follows:
1919 6 (40 ILCS 5/7-109.3) (from Ch. 108 1/2, par. 7-109.3)
2020 7 Sec. 7-109.3. "Sheriff's Law Enforcement Employees".
2121 8 (a) "Sheriff's law enforcement employee" or "SLEP" means:
2222 9 (1) A county sheriff and all deputies, other than
2323 10 special deputies, employed on a full time basis in the
2424 11 office of the sheriff.
2525 12 (2) A person who has elected to participate in this
2626 13 Fund under Section 3-109.1 of this Code, and who is
2727 14 employed by a participating municipality to perform police
2828 15 duties.
2929 16 (3) A law enforcement officer employed on a full time
3030 17 basis by a Forest Preserve District, provided that such
3131 18 officer shall be deemed a "sheriff's law enforcement
3232 19 employee" for the purposes of this Article, and service in
3333 20 that capacity shall be deemed to be service as a sheriff's
3434 21 law enforcement employee, only if the board of
3535 22 commissioners of the District have so elected by adoption
3636 23 of an affirmative resolution. Such election, once made,

7979 1 may not be rescinded.
8080 2 (4) A person not eligible to participate in a fund
8181 3 established under Article 3 of this Code who is employed
8282 4 on a full-time basis by a participating municipality or
8383 5 participating instrumentality to perform police duties at
8484 6 an airport, but only if the governing authority of the
8585 7 employer has approved sheriff's law enforcement employee
8686 8 status for its airport police employees by adoption of an
8787 9 affirmative resolution. Such approval, once given, may not
8888 10 be rescinded.
8989 11 (5) A person first hired on or after January 1, 2011
9090 12 who (i) is employed by a participating municipality that
9191 13 has both 30 or more full-time police officers and 50 or
9292 14 more full-time firefighters and has not established a fund
9393 15 under Article 3 or Article 4 of this Code and (ii) is
9494 16 employed on a full-time basis by that participating
9595 17 municipality to perform police duties or firefighting and
9696 18 EMS duties; but only if the governing authority of that
9797 19 municipality has approved sheriff's law enforcement
9898 20 employee status for its police officer or firefighter
9999 21 employees by adoption of an affirmative resolution. The
100100 22 resolution must specify that SLEP status shall be
101101 23 applicable to such employment occurring on or after the
102102 24 adoption of the resolution. Such resolution shall be
103103 25 irrevocable, but shall automatically terminate upon the
104104 26 establishment of an Article 3 or 4 fund by the

116116 2 (6) A person who is not eligible to participate in a
117117 3 fund established under Article 4 and is employed on a
118118 4 full-time basis by a participating municipality to perform
119119 5 duties as a paramedic, emergency medical technician (EMT),
120120 6 emergency medical technician-intermediate (EMT-I), or
121121 7 advanced emergency medical technician (A-EMT); but only if
122122 8 the governing authority of that municipality has approved
123123 9 sheriff's law enforcement employee status for such
124124 10 employees by adoption of an affirmative resolution. The
125125 11 resolution must specify that SLEP status shall be
126126 12 applicable to such employment occurring on or after the
127127 13 adoption of the resolution. Such resolution shall be
128128 14 irrevocable.
129129 15 (b) An employee who is a sheriff's law enforcement
130130 16 employee and is granted military leave or authorized leave of
131131 17 absence shall receive service credit in that capacity.
132132 18 Sheriff's law enforcement employees shall not be entitled to
133133 19 out-of-State service credit under Section 7-139.

149149 1 8 of this Act, no reimbursement by the State is required for
150150 2 the implementation of any mandate created by this amendatory
151151 3 Act of the 103rd General Assembly.
152152 4 Section 99. Effective date. This Act takes effect upon
