Except as otherwise 16 provided in this Code, if a candidate seeks to run for trustee 17 of a sanitary district in which trustees are not elected from 18 wards, then the candidate's petition for nomination must 19 contain at least the number of signatures equal to 0.5% of the 20 primary electors of his or her party from the sanitary 21 district. If a candidate seeks to run for trustee of a sanitary 22 district in which trustees are elected from wards, then the 23 candidate's petition for nomination must contain at least the 24 number of signatures equal to 0.5% of the primary electors of 25 his or her party in the ward of that sanitary district. Except as otherwise provided in this 6 Code, if a candidate seeks to run for judicial office in a 7 district, then the candidate's petition for nomination must 8 contain the number of signatures equal to 0.4% of the number of 9 votes cast in that district for the candidate for his or her 10 political party for the office of Governor at the last general 11 election at which a Governor was elected, but in no event less 12 than 500 signatures. If a candidate seeks to run for judicial 13 office in a circuit or subcircuit, then the candidate's 14 petition for nomination must contain the number of signatures 15 equal to 0.25% of the number of votes cast for the judicial 16 candidate of his or her political party who received the 17 highest number of votes at the last general election at which a 18 judicial officer from the same circuit or subcircuit was 19 regularly scheduled to be elected, but in no event less than 20 1,000 signatures in circuits and subcircuits located in the 21 First Judicial District or 500 signatures in every other 22 Judicial District. 23 (i) Precinct, ward, and township committeeperson. If a 2 candidate seeks to run for ward committeeperson, then the 3 candidate's petition for nomination must contain no less than 4 the number of signatures equal to 10% of the primary electors 5 of his or her party of the ward, but no more than 16% of those 6 same electors; provided that the maximum number of signatures 7 may be 50 more than the minimum number, whichever is greater. 8 If a candidate seeks to run for township committeeperson, then 9 the candidate's petition for nomination must contain no less 10 than the number of signatures equal to 5% of the primary 11 electors of his or her party of the township, but no more than 12 8% of those same electors; provided that the maximum number of 13 signatures may be 50 more than the minimum number, whichever 14 is greater. 15 (j) State's attorney or regional superintendent of schools 16 for multiple counties. If a candidate seeks to run for State's 17 attorney or regional Superintendent of Schools who serves more 18 than one county, then the candidate's petition for nomination 19 must contain at least the number of signatures equal to 0.5% of 20 the primary electors of his or her party in the territory 21 comprising the counties. 22 (k) Any other office. If a candidate seeks any other 23 office, then the candidate's petition for nomination must 24 contain at least the number of signatures equal to 0.5% of the 25 registered voters of the political subdivision, district, or 26 division for which the nomination is made or 25 signatures, HB3221 - 14 - LRB103 29900 BMS 56311 b HB3221- 15 -LRB103 29900 BMS 56311 b HB3221 - 15 - LRB103 29900 BMS 56311 b HB3221 - 15 - LRB103 29900 BMS 56311 b 1 whichever is greater. 2 For purposes of this Section the number of primary 3 electors shall be determined by taking the total vote cast, in 4 the applicable district, for the candidate for that political 5 party who received the highest number of votes, statewide, at 6 the last general election in the State at which electors for 7 President of the United States were elected. For political 8 subdivisions, the number of primary electors shall be 9 determined by taking the total vote cast for the candidate for 10 that political party who received the highest number of votes 11 in the political subdivision at the last regular election at 12 which an officer was regularly scheduled to be elected from 13 that subdivision. For wards or districts of political 14 subdivisions, the number of primary electors shall be 15 determined by taking the total vote cast for the candidate for 16 that political party who received the highest number of votes 17 in the ward or district at the last regular election at which 18 an officer was regularly scheduled to be elected from that 19 ward or district. 20 A "qualified primary elector" of a party may not sign 21 petitions for or be a candidate in the primary of more than one 22 party. 23 The changes made to this Section by Public Act 93-574 are 24 declarative of existing law, except for item (3) of subsection 25 (d). 26 Petitions of candidates for nomination for offices herein HB3221 - 15 - LRB103 29900 BMS 56311 b HB3221- 16 -LRB103 29900 BMS 56311 b HB3221 - 16 - LRB103 29900 BMS 56311 b HB3221 - 16 - LRB103 29900 BMS 56311 b 1 specified, to be filed with the same officer, may contain the 2 names of 2 or more candidates of the same political party for 3 the same or different offices. No petition sheet shall be 26 circulated more than 90 days preceding the last day provided HB3221 - 19 - LRB103 29900 BMS 56311 b HB3221- 20 -LRB103 29900 BMS 56311 b HB3221 - 20 - LRB103 29900 BMS 56311 b HB3221 - 20 - LRB103 29900 BMS 56311 b 1 in Section 8-9 for the filing of such petition. 2 All petition sheets which are filed with the State Board 3 of Elections shall be the original sheets which have been 4 signed by the voters and by the circulator, and not 5 photocopies or duplicates of such sheets. 6 The person circulating the petition, or the candidate on 7 whose behalf the petition is circulated, may strike any 8 signature from the petition, provided that: 9 (1) the person striking the signature shall initial 10 the petition at the place where the signature is struck; 11 and 12 (2) the person striking the signature shall sign a 13 certification listing the page number and line number of 14 each signature struck from the petition. In the 6 case of electors for President and Vice-President of the 7 United States, the names of candidates for President and 8 Vice-President may be added to the party name or appellation. 9 Such certificate of nomination or nomination papers in 10 addition shall include as a part thereof, the oath required by 11 Section 7-10.1 of this Act and must include a statement of 12 candidacy for each of the candidates named therein, except 13 candidates for electors for President and Vice-President of 14 the United States. If the nomination papers of any 8 candidate and the statement of economic interest of that 9 candidate are not required to be filed with the same officer, 10 the candidate must file with the officer with whom the 11 nomination papers are filed a receipt from the officer with 12 whom the statement of economic interests is filed showing the 13 date on which such statement was filed. Each petition for 3 nomination of a candidate must be signed by at least 5,000 but 4 not more than 10,000 legal voters of the city 12,500 legal 5 voters of the city. 6 (b-5) No rule or ordinance shall be passed that prevents 7 legal voters from signing petitions for nomination for 2 or 8 more candidates running for the same office. 9 (c) All such petitions, and procedure with respect 10 thereto, shall conform in other respects to the provisions of 11 the election and ballot laws then in force in the city of 12 Chicago concerning the nomination of independent candidates 13 for public office by petition.
