1 AN ACT concerning animals.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Humane Care for Animals Act is amended by
5 changing Section 4 as follows:
6 (510 ILCS 70/4) (from Ch. 8, par. 704)
7 Sec. 4. Prohibited acts. No person may sell, offer for
8 sale, barter, or give away as a pet or a novelty any rabbit,
9 hermit crab, goldfish, or any baby chick, duckling or other
10 fowl which has been dyed, colored, or otherwise treated to
11 impart an artificial color thereto. Baby chicks or ducklings
12 shall not be sold, offered for sale, bartered, or given away as
13 pets or novelties. Rabbits, ducklings or baby chicks shall not
14 be awarded as prizes.
15 No person may allow for the adoption, transfer, sale,
16 offer for sale, barter, or give away any animal forfeited or
17 relinquished under Section 3.04 or 3.05 of this Act to the
18 person who forfeited the animal or a person residing in that
19 person's household.
20 A person convicted of violating this Section is guilty of
21 a Class B misdemeanor. A second or subsequent violation is a
22 Class 4 felony, with every day that a violation continues
23 constituting a separate offense.
