1212 1 AN ACT concerning safety.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Electric Vehicle Rebate Act is amended by
1616 5 changing Section 10 and by adding Section 50 as follows:
1717 6 (415 ILCS 120/10)
1818 7 Sec. 10. Definitions. As used in this Act:
1919 8 "Agency" means the Environmental Protection Agency.
2020 9 "Covered Area" means the counties of Cook, DuPage, Kane,
2121 10 Lake, McHenry, and Will, the townships of Aux Sable and Goose
2222 11 Lake in Grundy County, and the township of Oswego in Kendall
2323 12 County.
2424 13 "Electric bicycle" means a bicycle equipped with an
2525 14 electric motor that may be activated in order to assist with or
2626 15 replace pedaling.
2727 16 "Electric vehicle" means a vehicle that is exclusively
2828 17 powered by and refueled by electricity, must be plugged in to
2929 18 charge, and is licensed to drive on public roadways. "Electric
3030 19 Vehicle" does not include electric bicycles, electric mopeds,
3131 20 electric off-highway vehicles, or hybrid electric vehicles and
3232 21 extended-range electric vehicles that are also equipped with
3333 22 conventional fueled propulsion or auxiliary engines.
3434 23 "Environmental justice community" has the same meaning,

7878 8 "Nonattainment area" means an area of the State that the
7979 9 United States Environmental Protection Agency has designated
8080 10 as being in nonattainment with a national ambient air quality
8181 11 standard.

8484 14 Sec. 50. Electric bicycle rebate.
8585 15 (a) Beginning July 1, 2024, and continuing as long as
8686 16 funds are available, a person may apply to the Agency for a
8787 17 rebate following the retail purchase of an electric bicycle in
8888 18 the State. Subject to appropriation, the Agency shall, upon
8989 19 receiving proof of the retail purchase of the electric bicycle
9090 20 in the State, award the purchaser a rebate under this Section
9191 21 in the amount of:
9292 22 (1) $750 for an electric bicycle sold to the retail
9393 23 purchaser for $1,750 or less;
9494 24 (2) $500 for an electric bicycle sold to the retail
9595 25 purchaser for more than $1,750 but less than $4,000; and

106106 1 (3) $250 for an electric bicycle sold to the retail
107107 2 purchaser for at least $4,000 but less than $5,000.
108108 3 (b) There shall be a secondary schedule for individuals
109109 4 who can provide proof of eligibility for the for Food
110110 5 Assistance for Women, Infants, and Children Program, the
111111 6 Supplemental Nutrition Assistance Program, or the Supplemental
112112 7 Low-Income Energy Assistance Program or whose household income
113113 8 is not greater than 300% of the federal poverty guidelines
114114 9 updated periodically in the Federal Register by the United
115115 10 States Department of Health and Human Services under the
116116 11 authority of 42 U.S.C. 9902(2). Under that schedule, a $1,000
117117 12 rebate would be provided for the first $2,000 spent. every
118118 13 dollar after up to $5,000. This calculation would give a
119119 14 maximum of $2,000 for a purchase of $5,000 and more.
120120 15 (c) If a community is located within a nonattainment area
121121 16 in the State, then purchasers from that community shall be
122122 17 prioritized for the electronic bicycle rebate program
123123 18 established in subsection (a).
124124 19 (d) The incentive for a rebate for an electronic bicycle
125125 20 under subsection (a) shall be available at the point of sale in
126126 21 order to maximize the impact for low and mid-income
127127 22 communities. A business in a nonattainment area as determined
128128 23 by the United States Environmental Protection Agency shall
129129 24 register with the Department of Revenue to directly receive
130130 25 rebates for the business' sale with the retailer collecting
131131 26 the following information: voucher number; employee name;
