1212 1 AN ACT concerning employment.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Illinois Wage Payment and Collection Act is
1616 5 amended by adding Sections 3.5 and 3.6 as follows:
1717 6 (820 ILCS 115/3.5 new)
1818 7 Sec. 3.5. Reporting time pay for nurses.
1919 8 (a) Except as required in Section 3.6, each workday a
2020 9 nurse is required to report for work, based upon a previously
2121 10 approved and distributed work schedule, and either (1) does
2222 11 report, but is not put to work or (2) was directed to not
2323 12 report, the nurse shall be paid for half the usual or scheduled
2424 13 day's work at the nurse's regular rate of pay, which shall not
2525 14 be less than the minimum wage.
2626 15 (b) The reporting time pay provisions established under
2727 16 this Section are not applicable when:
2828 17 (1) operations cannot commence or continue due to
2929 18 threats to employees or property or when recommended by
3030 19 civil authorities;
3131 20 (2) public utilities fail to supply electricity,
3232 21 water, or gas, or there is a failure in the public
3333 22 utilities or sewer system; or
3434 23 (3) the interruption of work is caused by an Act of God

7171 1 or other cause not within the employer's control.
7272 2 (c) This Section does not apply to a nurse on paid standby
7373 3 status who is called to perform assigned work at a time other
7474 4 than the nurse's scheduled reporting time.
7575 5 (d) This Section applies to all nurses, including those
7676 6 who use technology to overcome physical distance between
7777 7 patient and nurse to deliver nursing care and conduct nursing
7878 8 practice.

8080 10 Sec. 3.6. Reporting time pay for nurses; less than full
8181 11 schedule. Each workday a nurse is required to report for work,
8282 12 based upon a previously approved work schedule, and does
8383 13 report to work and is furnished less than one-half of the
8484 14 nurse's usual or scheduled day's work providing nursing
8585 15 services, the nurse shall be paid for all hours worked and
8686 16 shall be paid for one half of the remaining usual or scheduled
8787 17 day's work at the nurse's regular rate of pay.
8888 18 Section 99. Effective date. This Act takes effect January
8989 19 1, 2024.
