1 AN ACT concerning employment.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Wage Payment and Collection Act is
5 amended by adding Sections 3.5 and 3.6 as follows:
6 (820 ILCS 115/3.5 new)
7 Sec. 3.5. Reporting time pay for nurses.
8 (a) Except as required in Section 3.6, each workday a
9 nurse is required to report for work, based upon a previously
10 approved and distributed work schedule, and either (1) does
11 report, but is not put to work or (2) was directed to not
12 report, the nurse shall be paid for half the usual or scheduled
13 day's work at the nurse's regular rate of pay, which shall not
14 be less than the minimum wage.
15 (b) The reporting time pay provisions established under
16 this Section are not applicable when:
17 (1) operations cannot commence or continue due to
18 threats to employees or property or when recommended by
19 civil authorities;
20 (2) public utilities fail to supply electricity,
21 water, or gas, or there is a failure in the public
22 utilities or sewer system; or
23 (3) the interruption of work is caused by an Act of God

1 or other cause not within the employer's control.
2 (c) This Section does not apply to a nurse on paid standby
3 status who is called to perform assigned work at a time other
4 than the nurse's scheduled reporting time.
5 (d) This Section applies to all nurses, including those
6 who use technology to overcome physical distance between
7 patient and nurse to deliver nursing care and conduct nursing
8 practice.

10 Sec. 3.6. Reporting time pay for nurses; less than full
11 schedule. Each workday a nurse is required to report for work,
12 based upon a previously approved work schedule, and does
13 report to work and is furnished less than one-half of the
14 nurse's usual or scheduled day's work providing nursing
15 services, the nurse shall be paid for all hours worked and
16 shall be paid for one half of the remaining usual or scheduled
17 day's work at the nurse's regular rate of pay.
18 Section 99. Effective date. This Act takes effect January
19 1, 2024.
