11	11	1 AN ACT concerning employment.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. If and only if Senate Bill 208 of the 102nd
15	15	5 General Assembly becomes law, then the Paid Leave for All
16	16	6 Workers Act is amended by changing Section 10 as follows:

18	18	8 Sec. 10. Definitions. As used in this Act:
19	19	9 "Construction industry" means any constructing, altering,
20	20	10 reconstructing, repairing, rehabilitating, refinishing,
21	21	11 refurbishing, remodeling, remediating, renovating, custom
22	22	12 fabricating, maintenance, landscaping, improving, wrecking,
23	23	13 painting, decorating, demolishing, or adding to or subtracting
24	24	14 from any building, structure, highway, roadway, street,
25	25	15 bridge, alley, sewer, ditch, sewage disposal plant,
26	26	16 waterworks, parking facility, railroad, excavation or other
27	27	17 structure, project, development, real property, or
28	28	18 improvement, or to do any part thereof, whether or not the
29	29	19 performance of the work herein described involves the addition
30	30	20 to or fabrication into, any structure, project, development,
31	31	21 real property, or improvement herein described of any material
32	32	22 or article of merchandise.

68	68	1 related materials on the job site or to or from the job site,
69	69	2 snow plowing, snow removal, and refuse collection.
70	70	3 "Department" means the Illinois Department of Labor.
71	71	4 "Domestic work" and "domestic worker" have the same
72	72	5 meanings as defined in Section 10 of the Domestic Workers'
73	73	6 Bill of Rights Act, except that "domestic worker" also
74	74	7 includes independent contractors, sole proprietors, and
75	75	8 partnerships.
76	76	9 "Employee" has the same application and meaning as that
77	77	10 provided in Sections 1 and 2 of the Illinois Wage Payment and
78	78	11 Collection Act. "Employee" also includes all domestic workers,
79	79	12 and, for the purposes of this Act, domestic workers shall not
80	80	13 be excluded as employees under the provisions of item (1),
81	81	14 (2), or (3) of Section 2 of the Illinois Wage Payment and
82	82	15 Collection Act. "Employee" does not include:
83	83	16 (1) an employee as defined in the federal Railroad
84	84	17 Unemployment Insurance Act (45 U.S.C. 351 et seq.) or the
85	85	18 Railway Labor Act;
86	86	19 (2) a student enrolled in and regularly attending
87	87	20 classes in a college or university that is also the
88	88	21 student's employer, and who is employed on a temporary
89	89	22 basis at less than full time at the college or university,
90	90	23 but this exclusion applies only to work performed for that
91	91	24 college or university; or
92	92	25 (3) a short-term employee who is employed by an
93	93	26 institution of higher education for less than 2

104	104	1 consecutive calendar quarters during a calendar year and
105	105	2 who does not have a reasonable expectation that they will
106	106	3 be rehired by the same employer of the same service in a
107	107	4 subsequent calendar year.
108	108	5 "Employer" has the same application and meaning as that
109	109	6 provided in Sections 1 and 2 of the Illinois Wage Payment and
110	110	7 Collection Act, except that for purposes of this Act,
111	111	8 "employer" also means the State and units of local government,
112	112	9 any political subdivision of the State or units of local
113	113	10 government, or any State or local government agency.
114	114	11 "Employer" does not include school districts organized
115	115	12 under the School Code, or park districts organized under the
116	116	13 Park District Code, or municipalities that have a parks and
117	117	14 recreation department.
118	118	15 "Writing" or "written" means a printed or printable
119	119	16 communication in physical or electronic format, including a
120	120	17 communication that is transmitted through electronic mail,
121	121	18 text message, or a computer system or is otherwise sent or
122	122	19 stored electronically.
