1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Local Food, Farms, and Jobs Act is amended
1515 5 by changing Section 10 as follows:

1717 7 Sec. 10. Procurement goals for local farm or food
1818 8 products.
1919 9 (a) In order to create, strengthen, and expand local farm
2020 10 and food economies throughout Illinois, it shall be the goal
2121 11 of this State that 20% of all food and food products purchased
2222 12 by State agencies and State-owned facilities, including,
2323 13 without limitation, facilities for persons with mental health
2424 14 and developmental disabilities, correctional facilities, and
2525 15 public universities, shall, by 2020 onward, be local farm or
2626 16 food products.
2727 17 (a-5) Of the 20% of local farm or food products required to
2828 18 be purchased by State agencies under subsection (a), at least
2929 19 10% of the local farm or food products shall be purchased from
3030 20 minority-owned food producers.
3131 21 (b) The State shall require that at least 20% support and
3232 22 encourage that 10% of food and food products purchased by
3333 23 entities funded in part or in whole by State dollars, which

6868 1 spend funds more than $25,000 per year on food or food products
6969 2 for its students, residents, or clients, including, without
7070 3 limitation, public schools, child care facilities,
7171 4 after-school programs, and hospitals, shall, by 2023 onward
7272 5 2020, be local farm or food products.
7373 6 (b-5) Of the 20% of local farm or food products required to
7474 7 be purchased by State-funded entities under subsection (b), at
7575 8 least 10% of the local farm or food products shall be purchased
7676 9 from minority-owned food producers.
7777 10 (c) To meet the goals set forth in this Section, when a
7878 11 State contract for purchase of food or food products is to be
7979 12 awarded to the lowest responsible bidder, an otherwise
8080 13 qualified bidder who will fulfill the contract through the use
8181 14 of local farm or food products may be given preference over
8282 15 other bidders, provided that the cost included in the bid of
8383 16 local farm or food products is not more than 10% greater than
8484 17 the cost included in a bid that is not for local farm or food
8585 18 products.
8686 19 (d) All State agencies and State-owned facilities that
8787 20 purchase food and food products shall develop a system for (i)
8888 21 identifying the percentage of local farm or food products
8989 22 purchased for fiscal year 2021 as the baseline; and (ii)
9090 23 tracking and reporting local farm or food products purchases
9191 24 on an annual basis.
9292 25 (e) On January 1, 2024 and each January 1 thereafter,
9393 26 those State agencies and State-owned facilities that purchase

105105 2 procurement bulletins, in the form and format prescribed by
106106 3 the chief procurement officer, notice of their purchases of
107107 4 local farm or food products in the immediately preceding
108108 5 fiscal year.
